Subject: Spouse sponsor questions. Help greatly appreciated
  Hi.

I have hunted and hunted both on the CIC website/guides and this fantastic forum but am unable to find answers regarding some questions on the visa forms.

Our situation outlined.
I am Canadian by birth. I have been living in the UK for the past 9.5 years. I have been married to my Scottish wife (whom I met whilst living here in the UK) for 6 months but have been living together for 8.5 years, owned houses together, been on holidays, etc. (so, I don´t believe there are any issues regarding our relationship as being genuine etc.). As mentioned, we are still living in the UK. We intend to move as soon as possible. We both have been self employed for a few years now.

Taking the above into account, here are my questions:

App. to Sponsor & Undertaking IMM 1344

1. Section A Q.10 "Are you a Canadian citizen? No_ Yes_ Became citizen on________."
I am Canadian by birth but surely the form is not asking me to put my DOB here? Do I tick yes and leave the date section blank?

2. Section C Q.6 "If you are sponsoring a member of the spouse...in Canada class do not complete b) and c)..."
I don´t understand what is meant by ´Canada class´. Am I reading the question incorrectly?

3. Section E Q.4 "Do I reside in Canada?" As I am currently not, I believe I would answer no. But that seems to be saying that I intend to sponsor my wife from outside Canada, which is not the intention. I understand section F seems to clear this inconsistency up, but I thought Perm. Res. came after the 3 year sponsor period was complete. Sorry if I have gotten that wrong.

Sponsor Questionnaire IMM 5540

4. Q.6-7 "Are you currently employed?" "Starting with your current employer..." As stated, I am self employed so am confused as to how to answer these two questions.

Lastly, I see our circumstance as fairly straight forward in essence. I´m Canadian, are relationship has existed for 8+ years, my wife´s medical has been completed with no problems, she has had a police check, we have no dependants and (from what I have learned) spousal sponsors do not have to meet income requirements. Therefore, would be be a bad idea for us to head out before the visa process is complete? If that is fine, is heading out half way through the process a problem?

My dad is out in Canada and has cancer, so we really want to get out there as soon as possible.

Thank you very much for any help. I appreciate my post is long. I just wanted to ensure I was as clear as possible.

Cheers.

Write "by birth " on Became Citizen Space

Sometimes people call their spouses to Canada and sponsor them while they are in Canada and same goes with few more categories where applicants are in Canada and apply for PR status through various programs. Those are called IN CANADA APPLICANTS/APPLICATIONS/CLASS

If you are self employed, provide the deatil of your business address, name of your business, the day you statrted this business and your position as Managaing Director or wahtever capacity you are in your business or Business Owner.

I am not sure if you are required to be in Canada physically to sponsor your spouse. So you may wait for comments by soem experts on this forum.

Thank you very much for the response Mike. That has helped. I´ll see if, as you say, if any experts can shed light on the other questions.

Thanks again.

Dave
