I am also postting the comments on the FOSS which do not look very promising to me.

applicant is 64 years old widowed. He has 3 children in his country of origin and son in Canada does not meet LICO requireemnts. He seeks for H&C for the following reasons: He has no one to look after her in his country and to enable his son and daughter-in-law to pursue their own business. Subject is not elederly and his own mother is alive living with his brother. His son has only been in Canada since jan 2005 and it appears there would be no undue hardship for his son to sponsor his father in the prescribed manner at a later date when he is able to meet LICO requirements. Refering to CIC for final decision.

ROY PLEASE GIVE ME YOUR HONEST OPINION AND SUGGEST IF WHAT DO YOU THINK THE CHANCES HE HAS AND TELL ME IF HIRING ANY CONSULTANT OR LAWYER AT THIS STAGE WOULD BE OF ANY HELP OR NOT?

Mike respectfully this is more then just a question.

Not really suitable for this forum. It all depends on exactly how connected you are and if you can prove same. What you wrote as reasons etc. etc.

Sometimes it takes me three months to write a really good submission and I focus on children issues, processing times etc.

Compassion is common sense and if it is common sense to you then it will be to someone else.

Thanks for your comments ROY. I agree that compassion is common sense but in this case i am noticing there is no common sense. Just because my grand mother is alive and living with my uncle does not mean that my father is not elderly person. He is 64 and his mother is 92, now if his mother is alive then what he can do about it. Visa officer should not assume that he is not elederly only because his mother is alive. Anyways, i do not know what is gonna happen.

perhaps the issues is that they don´t quite understand the compassion part when he has significant family at home that can help with the situation. or, perhaps that they are concerned he will turn around and sponsor Grandma who will attempt to sponsor uncle and they simply don´t want to go there?

don´t know. The question may be that there are enough options back home for until this child is legal age to not proceed.

Mike in two years you will meet the LICO and your parents will have assisted you in increasing any business etc.

Roy.......i promise to behave and i apprecaite pro bono offer, will be waiting for it....will prey for you day and night, i swear.

Sharon, i apprecaite your comments, time can only tell if you are right or right. So far i do not see any compassion but they need to understand that brothers and sisters have their own life, their own families, why would they keep my father when some of them are depending upon their kids.

I am totally confused and really have no idea how to proceed further.

Just google FOSS and you will get the link. Print out the form, fill it up and send it to the address provided. I received Foss within 2 weeks.
