Subject: Arranged employment opinion
  Hello,
I have a question, if I secure a positive opinion from HRDC, is the employer obliged to keep me hired in his company forever? I am confused, with the term indeterminate employment. If the employmer doesn´t like my skills and finds me inefficent, can he fire me?

Dear Miri,

If you get the job in Canada then it is not compulsory that you have to work under one employer for forever , if you want you can join the new job also, so in the same way if the employer is also not satisfy with your performance then he may also fire you off, in short in Canada it is not compulsory to work under one employer till lifetime , you may relocate your job destination , this is the fact and I have got this information from my brother because right now he is in Canada

And further to that if the employer is harassing or troubling you then you may approach the Canadian labour and file the case against him, because Canada government have strict rules against labour and the employers can?t harass the employee by exceeding the time lime of employee, not giving salary to employee on time, abused etc if such happens then you may file a report against him

Hello Ashish,
thank you so much for replying back so quickly. This is what I thought, but the employer who may apply for an arranged employment opinion is a little bit sceptical, because he thinks that if he offers me a permanent job, he will be stuck with me forever, in other words,he will be have to cover me financially if I don´t like the job and leave or vise versa he won´t be able to lay me off, if he thinks that I won´t be apt for the job.

Let me try and answer the question. If you get a positive labor market opinion from HRDC then you can only work for that employer for the duration of your contract (example 2 years or 3 years). For low skilled work you need the LMO and a work permit (you can apply at the port of entry). If you want to apply for a different job or move and work in a different area you need a new work permit and lmo! Do you understand? That means that HRDC is giving that employer permission to hire you only for that job. If you don´t like that job then you CANNOT just change employers. That is illegal and you are breaking immigration law. Of course you can quit your job anytime you want. But if you are no longer working for that employer that you came here to work for then you MUST leave Canada because you no longer have a valid reason for being in the country!

One more thing. If the employer fires you or changes their mind and does not want you anymore than you must leave Canada.
You will have already signed a contract so you may have some rights if the employer fires you before the contract is over but if not then you cannot go and get another job with another employer. You need permission from CIC and CBSA to do that!

I understand all your replies here but I just wanna be sure.Right now, I´m applying for a PR ( permanent residence Visa) and an agency is helping me out. They said that they will use the AEO scheme. Here are my questions:

1.If an employer issued an AEO to me, is he really OBLIGED to hire me and wait for me or does he has the right to terminate and not wait for me until I land in Canada?

2. When I land in Canada, if the job is still available, can I reject the job that is being offered to me and not work for that company even though they issued an AEO to me? Or should I really have to work for them?

3. If the agency that is helping me out told me that once I land in Canada, the job will not be available anymore, is this illegal???

I know that LMO and AEO is a two different thing. I´m just concentrating on the AEO and not LMO. The agency that is helping me is applying for the AEO because it can add points since applying for a PR Visa is by point system.

I have applied for Canadian immigration for about 3 years ago as a skilled worker. I´ve got my BA in mechanical engineering for about 10 years ago and my master in business administration (MBA) from well known governmental universities . It´s about 5 years that I work for a petroleum and gas engineering company as a HVAC engineer, and also had been in the position of HVAC sales engineer & overseas marketing officer for about 4 years. When I applied for the Canadian permanent residence, my wife was a medical student; however now she´s a general practitioner . can I expedite my immigration process by getting an arranged employment for me or my wife . how can I find a job when I am not there?
