Subject: screwed on taxes - any help?
  Good Day all,
I got a letter stating that I owe a large amount of money to the IRS from late filing and under paid taxes.

I filed my US 2006 taxes late (in March 2008)
I am living in Canada, Have been here for 3.5 years without leaving, I make under $80,000 and the US is still taxing me. They say I do no qualify for the "2555 foreign earned income form" How can I fight this and get my money back? I understand the interest/penalty but not the owing taxes.

Any advice?

Why did you file US taxes? Are you American? If not, did you expect them to pay you back some dough? Not clear. If you made money in the US in any tax year, you are expected to claim it at the end of the tax year. Unlike canada, I think the US does not allow late filing even if they owe you. Late filing itself gets you in trouble. If you are a US citizen, not filing tax for any year is criminal and can get you upto one year in jail AND fines. If you are not an American and they owed you money and you did not claim it on time, I would say you got yourself into trouble by rocking the boat! You have my sympathies but otherwise I do not think you can fight this being in Canada. You can go to the US and call them (any calls to IRS from outside US will go into loop and you can´t speak to anyone live) and nicely plead with them or to a judge and have the penalties dropped. Or you can hire one of those US tax attorneys to represent you and negotiate a more reasonable settlement. Good luck in any case.

The Foreign Earned Income Exclusion (detailed in above publication) may apply to you:

If you meet certain requirements, you may qualify for the foreign earned income and foreign housing exclusions and the foreign housing deduction.

If you are a U.S. citizen or a resident alien of the United States and you live abroad, you are taxed on your worldwide income. However, you may qualify to exclude from income up to $85,700 of your foreign earnings. In addition, you can exclude or deduct certain foreign housing amounts.
