Subject: Non-resident foreign spouse entering Canada:status
  Hello all,

I am a Canadian citizen who will soon marry a South Korean national in Toronto. After our wedding, we will travel to Korea to have (another) Korean wedding with her family and relatives. At the end of all this, she and I expect to return to Canada and commence sponsorship and PR applications. With settling in mind, my plan is to have her travel on a one-way ticket from Korea to Canada. My question is will CBSA let her in, knowing she is on a one-way ticket and assuming CBSA considers her under a tourist visa?

Even if she has a return ticket, do you forsee CBSA refusing her entry? (Aside from criminality and odd reasons -- we´ve simple and clean histories and no prior run-in´s with authorities or shoddy enterprises.)

Will it help if we travel with our Ontario marriage certificate?

My questions concern the entry and travel logistics of our wedding plans, not sponsorship or PR procedures. All advice greatly appreciated. Many thanks

David

Oh yeah, CBSA could refuse her entry.
Under a visitor visa she has to prove at the port of entry that her intentions of visting Canada are under temporary basis, and obiviously there ain´t.

To be in the safe side, you should either start the sponsorship and permanent resident process in Canada and STAY in Canada until she becomes a PR or go to her home country and apply from abroad and come back to Canada once she becomes a PR.

What you are planning on doing, may work but there is a very high probability that she can be refuse of entry.

Cheers

Bill

Spouse rendered stateless (in reply to: Non-resident foreign spouse entering Canada:status)
Hi

My family and I relocated to Canada last year 2009 after my husband and I got working visas.

I wanted to apply for a new passport at the embassy of the country where I come from as my current passport is expiring in 3 months time from now. I was surprised when I was told that I couldn´t apply for one as I had to renounce my citizenship of another country, that I don´t even have. I have now been rendered stateless and I don´t know what to do about this issue. Could someone advise how I can handle this issue.

Isabel

Filipino Divorce (in reply to: Non-resident foreign spouse entering Canada:status)
I married a Filipina 3 years ago she was divorced from her husband 18+ years ago ! After we married and started the immigration to Canada we found out that although she has a US Divorce she would require an annullment ! Well the annullment took two years and a lot of time and money he might be able to get an annullment but it won´t be a short time in doing so ! Even if you greased the wheel the government works slowly Count on at least two years ! I amsure your marriage in Korea it would be recognized and if he gets the annullment it would also be recognized for the cenomar document ! Good Luck and God Bless !
