  BELOW IS YET ANOTHER ARTICLE FROM THE TORONTO STAR RAISING CONCERNS ABOUT THE PROPOSED LEGISLATION CHANGES THAT ARE CLOSE TO BECOMING A REALITY. "I HAVE BEEN AGAINST THIS LEGISLATION SINCE DAY ONE".

Don DeVoretz SHOULD READ THE 2000 AUDITOR GENERAL REPORT BEFORE COMMENTING ON THIS ISSUE. THE WHOLE ISSUE OF OFFSHORE APPLICANTS WERE NOTHING BUT A RED HERRING IN THE CREATION OF REGULATION 11 AND THEN THE CREATION OF IELTS TESTING. THOSE TWO ISSUES ALONE HAS BEEN THE MAIN REASON FOR THE CURRENT BACKLOG.


IF ALL VISA POSTS COULD COMPLETE 80% OF FSW APPLICATIONS WITHIN 13 MONTHS IN 1996 THEN AFTER A DEPARTMENTAL DIRECTIVE STATING THAT ALL OFF SHORE APPLICANTS HAD TO BE INTERVIEWED THE 80% PROCESSING TIMES FROM ALL VISA POSTS FOR FSW APPLICATIONS JUMPED TO 25 MONTHS THEN NOW WITH IELTS TESTING TO 68 MONTHS-----------NOW AN INVESTOR WHO ONLY NEEDS 35 POINTS NEEDS TO TAKE A LANGUAGE TEST TO GIVE THE GOVERNMENT $400,000.00 CA

THE POOR LITTLE VISA OFFICERS ARE OVER WORKED AND CAN´T ASSESS THAT A PERSON EDUCATED IN ENGLAND, FRANCE, USA OR ANY COUNTRY THAT THE PRINCIPAL LANGUAGE IS ONE OF CANADA´S OFFICIAL LANGUAGES NEED NOT A LANGUAGE TEST. NOT LIKELY!

Canada´s immigration system isn´t perfect. If it were, highly educated immigrants wouldn´t be waiting years to get into the country or, once here, floundering in low-wage jobs while struggling to get their credentials recognized or the Canadian experience employers demand.
Those problems are unlikely to be solved, however, by the fundamental changes Prime Minister Stephen Harper insists have to be made to the Immigration Act. The amendments now before Parliament would give sweeping new powers to the immigration minister to cap the number of applicants each year and to pick and choose which immigrants are admitted. Harper says the changes are needed to deal with the current backlog of 925,000 applicants and to get much-needed skilled workers into the country more quickly.
But the backlog is "a red herring," says Don DeVoretz, co-director of RIIM, Vancouver´s Centre for Research on Immigration and Integration in the Metropolis. In fact, it is "a manifestation of cutback after cutback after cutback" to staffing levels in the immigration department, he says. And the proposed changes to the Immigration Act will apply only to applications submitted after the end of February this year. They will not apply retroactively to the current backlog.
And while it is laudable that the government wants to fast track applicants who have the skills Canada requires, each of the provinces has different skill needs. Ontario has labour shortages in construction, mining and the high-tech sector while Saskatchewan needs machine operators and pipe fitters. Which groups will make the cut?
No one knows because Immigration Minister Diane Finley has not released a list of priority occupations. And while she says the government has no intention of limiting the number of family-class applications, she will not say whether they will be among the priority groups.
In other words, predictable rules are being replaced with unpredictable ones. That has cased widespread confusion, uncertainty and fear about a "hidden agenda" in immigrant communities.
The Canadian Bar Association, among others, is now urging Parliament to remove the immigration amendments from its broad budget bill and vote them down. The lawyers´ group argues that the government already has sufficient powers to both address the backlog and prioritize applicants in certain fields without these changes.
"The bill represents a major step backwards in the evolution of Canadian immigration law," said Stephen Green, executive member of the association´s national citizenship and immigration law section.
Last week, the Commons immigration committee concurred and recommended that the amendments be stripped from the budget bill, with the opposition MPs ganging up to outvote the Conservatives. But that recommendation must still be adopted by the finance committee and by the full House, where the Liberals, fearing an election call as a budget bill is considered a confidence measure, may support the government in the end.
That would be unfortunate. If, as the government contends, the immigration amendments are necessary and defensible, they ought to be able to stand on their own.

the solution is clear to the backlog problem, they have to take exemple from australia,
the selection must be done at the same time with the security check and medicals , the systeme now is
1-selection after interview or not
2-medical and security check
if the process is is not a hard case
but if they do both at the same time , you already save half of the waiting, they better make the applicant pay 1500 dolllars for that than let them wait 7 years, would you pay 1500 for 1 year or save 1000 and wait 6 more years ?
so when the result come positive for the security and selection the applicant is called for interview ,if he pass he has his visa same day

WHERE IS THE OUTRAGE OVER THIS LEGISLATION--HERE? WAKEUP PEOPLE!!!!! WHY IS THIS IMMORAL LEGISLATION BEING FORCED THROUGH THE COMMONS?

COME ON PEOPLE ARE YOU FOCUSED ON IT MIGHT HELP ME SO I´LL BE QUIET? DON´T EXPECT OTHERS TO STAND UP FOR YOU IN THE FUTURE WITH THAT THINKING.

HEY WHAT IF THE MINISTER AFTER THE LEGISLATION IS PASSED SAYS WE HAVE TOO MANY CHINESE, ARAB OR JEWISH IMMIGRANTS SO NO BODY GETS IN FROM THOSE COUNTRIES. THE LEGISLATION IN THEORY WILL ALLOW HER TO DO THAT. TOO MUCH POWER CORRUPTS!

WHAT OCCUPATIONS WILL THEY FOCUS ON? HRSDC ALREADY HAS OCCUPATIONS UNDER PRESSURE LISTS FOR VARIOUS PROVINCES BUT CIC HAS NOT STATED THOSE OCCUPATIONS WILL BE FAST TRACKED. COULD MS. FINLAY BUDDY WHO NEEDS _________ WORKERS GET THEM FAST TRACKED EVEN THOUGH THEY ARE NOT NEEDED IN CANADA?

HOW CAN ANYONE FEEL RIGHT ABOUT JUMPING TO THE FRONT OF THE LINE AFTER BOB, CHEN, MOHAMMED OR EMIR HAVE BEEN WAITING FOR YEARS.

YEAH (*^@#&%) THEM I´M IN, THEN THE GOVERNMENT CHANGES A DIFFERENT LAW THAT TREATS YOU TOTALLY UNFAIRLY AND THEN YOUR OUTRAGED. TOO LATE.

COMPASSION IS SHOWN TO THOSE WHO SHOW COMPASSION TO OTHERS!

Dear Roy,

You are right, as you know in US they have stopped allowing people winning Green Card through lottery, like people from Asia, India, Brasil, Mexico, Rusia, etc because they have enough people from these countries

It might be the same for CANADA, (I am not trying to discriminate) but they (CIC) woke up and said, STOP, too many Chinese people, how to stop this, maybe they are really thinking to stop, and allow people to immigrate in Canada with a low rate of immigration, like eastern Europe, etc...

What do you think if in 20 years, half of people in CANADA will be Chinesse, will that sound good for CANADA

Sorry I didnt want to discriminate anyone, but I took the Chinese example because they are on TOP immigrants in CA.

The other issue is any law has to comply with the Charter of Rights and Freedoms and all of its provisions.

This legislation is a clear violation of the equality provisions.

NOT RENDERING A DECISION IS NOT A REFUSAL NOR ACCEPTANCE!!!!

THIS ACTION OR LACK OF IS NOT SOMETHING THAT CAN BE APPEALED BECAUSE THEIR IS NO DECISION RENDERED.

CAN ANYONE IMAGINE ANYONE FROM ANY COUNTRY WAITING A WEEK OR SIX YEARS TO BE LEFT WAITING LONGER--------IN PROCESS---IS THE MOST DEPRESSING STATUS ANYONE CAN EVER SEE ON THEIR FILE.

IN THE FUTURE IF THIS LEGISLATION IS ALLOWED EVERYONE WILL SEE IN PROCESS FOR EVER.

Roy, if this is so terrible (and I totally appreciate your concerns regardless of who is in power) please give us a different idea of how to address the backlog and the mismatch between skills and job availability. What should the government be doing?

I never take a stand regarding a problem unless I have a solution that decreases the original problem. Regulation 11, Language testing, Fraudulent Documents, Crooked Staff and lazy Visa Officers caused the current backlog

Immigration is a cash cow and always has been for the government of Canada.

What is the problem with pre-screening all FSW applications in Newfoundland, NWT, Yukon or downtown Surrey, BC to create employment?

Once there is a need to confirm employment send the file back to the Visa Post to confirm Mr. XYZ works at ABC company. Pre screening is done by the local employees at the Visa Posts responsible for the country involved, THIS IS WHERE THE BACKLOG OCCURS.

Training Canadians who are fluent in the official language is ten times easier then training foreign nationals to do the same task with limited English ability.

Fraud by staff is excessive at most Visa Posts and this idea would drastically reduce fraud by locals. Then those workers would not have to wait for their bribes and be free to complete work permits and CVV´s.

This regulation 11 keeps an Investor from Iran waiting 70 months to be processed when he is giving the government $400,000.00 for five years at no interest.

THAT IS BAD BUSINESS PROCEDURE in any country.

We can and should do better.

The new legislation does not get rid of the backlog in any way shape or form. The future backlog YES but not the current backlog.
