Hello!
My mom came to me 8 months ago from Israel and did not extend her stay. So, as I understood from CIC site she is without status now. I would like to apply for her on H and C to become a PR but would her status affect the case. I am asking because a gay from CIC Service said he must be here legally. Any advice?

Well, you should have applied for her extension on time. Now apply for restoration of status. You are applying for compassion then you must show some respect to CIC rules as well. When there is an option to extend the visa then why voilate it. Makes sense?

get immigration lawyer/consultant and apply for h &c as quick as possible!

You need to show how devastated you would be as a son if your Mother would have to go home and apply from abroad. You need to come up with deep pockets to go to a Doctor that will say you have trouble thinking of your mother in the home country laying on her kitchen floor with a broken hip unable to get up etc. etc. etc.
Talk about processing times compared to ____ and throw everything including the kitchen sink.
This is your Mommy (no pun intended) so either step up tio the plate and do it right the first times or do it from abroad and wait six years.
