Could you please help me. My refugee claimant application was not successful in 2006. I then submitted my H&C application in November 2006. My application was transferred to the Local Office in February 2007.

Since then i havent recieved any correspondence from the local Office. I then requested for the FOSS notes.

i got the FOSS notes and included with the FOSS notes was a letter and i will quote from it :

"Enclosed please find a portion of the information requested. There has been information identified on your file which has been sent to the Public Rights Administration in Ottawa for possible exemption. If these documents are exempted the information will not be released to you"

Does it mean that my H&C application wasnt approved? whenever i check for the status of my application it´s still In Process mode.

I cant be removed to my country of origin right now because it is under Ministerial monotorium.

i dont know what to do now. I have established very well in Alberta.

just wait, your application is in the backlog pipe line. so sit back and stay well established. u will receive remaining FOSS notes later.
i am waiting for my H & C results since 2003. all i know that CIC transfer my file to local office and then local office transfer it to somewhere else under work load sharing program.

This means that there is something on the file that needs a higher ranking person to authorize its release.

What your referring to is a letter on the first page of your foss notes release.

Go back and request the whole file. Any NCB´s non computer entry notes will not be there.

I am from Zimbabwe. There are two guys who submitted their H&C after me and they have already recieved positive results from CIC.

I am just wondering why its taking so long on my case?

Did they receive positive results from Vegreville, Alberta or local office. I assume, local office takes a lot of time if your file does not get first stage approval from Vegreville, Alberta. My dad´s H&C application is also in process and Vegreville has transferred it to local office. I met with one of the top lawyers of GTA few days ago and he told me that when a file is transferred to local office, it is 99.9% a Refusal a NO.....so i am really worried about my dad and plan to submitt a family sponsor next year, when hopefully, i will be bale to meet LICO...what do you say?

Their files were transferred to Local CIC offices. They didnt get first stage approval from Vegreville. I really dont know if your lawyers were right or not.
