Subject: Does it help to complaint
  Hi Friends,

I am into a serious money matters issues with a Toronto Immigration Lawyer and if the problem is not resolved, i am going file a compliant against his firm with Law Society, Human Rights Commission, Ombudsman and BBB.

I was wondering if this is going to help or not? Can that immigration lawyer ruin the file of my dad because she claims that she has very close relations with CIC officers and she even proved it to me during initial consultation. She is not willing to refund me the money which was held in trust account and we did not reach into an agreement and decided to seperate our ways but she is refusing to pay my money back which is over 1000 dollars.

I need your advise, please help.

it all depends on the contract you signed. what does it say about termination?

if you signed the contract and it says the lawyer is not required to refund your money... all the complaints in the world won´t help you.

What would the Human Rights commission have to do with this?

No contract is signed. She charged my credit card and told me that i shall get the retainer agreement and payment recipets in the mail which i never got. No contract was signed. It was verbally told that money will stay into a trust account until we sign an agreement and we never signed an agreement.

Human Rights Commission has lawyers as well and they deal with these situation when someone is black-mailed because he/she has all the information about the file and tries to exploit the situation by keeping ones money for no reason and bluntly refuse to pay. Anyhow if it does not work with HUman Rights, i can consider other options.

But i never signed an agreement.

Regarding your money,this is something that you may not like it but that is the way it is:

IF IS NOT WRITTEN IT DIDN´T HAPPEN.

It is your word against his/her. Can you probe it?

how long ago was the credit card charge? maybe you can dispute the charge.

getting excited and hostile will help you nothing. try being calm and business like in this situation. You may get a little more respect... also may get the information you are needing about your application

Credit card was charged few days ago. Trust me i am handling it with a lot of patience and i very calm which is somthing very irritating for me in this situation but i want to handle this professionally because i am dealing with a group of lawyers and they know the trick to deal with such situations. Anyways, i have told them give me atleast 50% of the money and if they dont then i shall file a complaint law society, ombudsman and bbb. And i shall contact C TV as well and tell the world how these lawyers cheat. Thanks for your comments sharon.

same thing happened with me and he paid me my money back.

CTV does not care. you did not get anything in writing before handing over your credit card - that is your problem not anyone elses. Seriously, you best bet is to complain to VISA.

Only a thousand dollar retainer to assist with a H&C? Why so little?

A thousand to improve a H&C. Nope it was to speak to an officer at Scarborough CIC and do something under the table to approve your fathers application. Right?????

Believing that any representative can get to the (actual) officer assigned to your (personal file) for a thousand dollars and then do something to approve your fathers case.

How much do you think the CIC officers bribe was going to be to destroy their career?

COME ON PEOPLE WHEN IT IS TOO GOOD TO BE TRUE ----WAKE UP!

Mike I´m disappointed in you.

When you get in bed with a crook to do something illegal, immoral etc. some of the blame has to stick on you.

Are you crazy Roy, how can you assume something stupid like bribing CIC officer and if that happens in real then i am defintely going to do that....and you are saying it on record.....I am surprised that in a a country like Canada system has so many holes that CIC officers take bribes (according to Roy). I do not know this but as ROY a famous Consultant is saying so i belive that.

Now come to the point. May be Mr. Roy did not read my post very clearly. Anyhow, ROY, if you know someone who accepts bribes and approves the cases, do let me know. Besides paying him, i shall give you a tip as well. You are pissed off because i did not take your pro bono offer and approached another crook.....however, trust me, i know how to deal with the crooks, i do not care if my dad´s application is approved or not, or he is kicked out of the country, or even i am kicked out of the country, but i will bring that crook into public for sure and very soon you will see my real face with the news in papers and on TV, very soon if that crook does not pay my money back.

I am a passimist and i expect the worst and plan the worst.

Mike it is a well publicized fact that CIC officers are human and some have crossed the line. All you have to do is google or read auditor general report or read about the W5 report when Hong Kong was closing.

Mike you used the tem (very close relations with CIC officers). Mike if I´m famous and win H&C cases why did you hire this Lawyer? Due to her "very close relations"?

When you expect the negative things negative things come to you. When you hire a representative and do not get a contract as to what is to be done or not done you are part of the problem so accept that.

You knew I worked for CIC but I would never and am not allowed to pretend to have special influence with CIC staff and neither can a member of the LSUC. Check out the CSIC code of conduct and the LSUC.

They do not dispute the amount any Lawyer may charge for services but they do require a retainer agreement.

I´m on the record that is your words google away you will find that and I assumed maybe incorrectly that is why you posted the other OLD item regarding Mr. Ellis.

NO CONTRACT NO COMPLAINT just like Bill said.

You made your bed so now sleep in it.
