Subject: US Immigration problem
My wife entered the US illegally last year using someone elses passport and she was finger printed. She tried applying for a US Visa this year and her finger print came up under another persons name. She was not arrested but the case was sent to the police in India for further investigation. Now, she is a Canadian PR and has been out for 1 month in India. Can she expect any problem when re-entering Canada?

In these days of identity theft, false impersonation and terrorism... I would say she is in for a big problem. How and why on earth did she do that knowing fully well how paranoid the US is about people sneaking in with wrong ID to blow up things! And after succeeding in the deed, and knowing fully well her finger prints are in their database, why did she try to fool them again? If the US knows she is in or is coming to Canada, they will extend the investigation to Canada and that pretty much seals her fate. Does India have an anti-terror law or agency similar to CSIS in Canada? If so, and if they are serious about their business, she is already in major situation. Keep hoping the Indians won´t rescind her passport and confine her to India for a number of years... If I am right, they will force her to stay put (in India) for 3-5 years.

She is Canadian PR under her own name and has been for 3 yrs.
My fear is "does the US and Canada share the same database and how will Canada handle a PR with immigration problems in US?"

From what I know and have read, the US and Canada share all kinds of data for mutual self-interest, especially in these times. Immigration, visa, and tax data are among these. I assume Canada could well be informed of the situation, and the information entered in the database under the PR´s record. It may come up on next entry into Canada.

My question is if you´re the spouse, how could you in good conscience allow someone I assume you care about behave so recklessly?

Not much to be done except avoid US entry, and see what happens on the Canada side.

not sure what prompted the lapse in thinking but she could be in serious doo doo. Hopefully, you are prepared for what might come next.

At this point in time, since there isn´t much to do about what was done, the best strategy is to simply avoid the US (as Richard above noted) and return to Canada straight and stay put in Canada. Not much I can say.

Buddy you opened new case for the Canadian Immigration, where they have to see that "is she the real immigrant or she used someone else documents and husband?"

Her fate in the US is doomed, no doubt (she deserves it no doubt).

However, regarding just this problem I don´t think she´ll have any problem in entering Canada. As long as her PR status is valid and US authority doesn´t send any especial note for her (which I doubt).

US authorities have many thousands cases like to handle..with much more serious offence. I know few guys who were caught/deported from the US while having PR status in Canada. They are now proud Canadia citizens. I don´t think that the Canadians care much for violation of US immigration. However, if instead of her a male with middle eastern or Pakistani backround then I would be very scenic.

Update - Thanx for all the comments guys and some guys need to understand that this is a help forum and not a "bash a man who is already down" forum. She entered Canada without any reference to the situation and all is well. Thanx.
