Subject: STUDY PERMIT APPLICANT, DENIED REFUGEE CLAIMANT
  Hi Everyone,

I have applied for a Study Permit from Pakistan. I have a history in Canada though: My family and I had applied for refugee status in Canada in January of 2003. I lived in Canada from January 2003 up until June 2007. We were determined not to be ?Convention refugees? and were denied PR status in Canada. Prior to living in Canada, we lived in the United States from August 1995 to January 2003. My father?s five-year visa had expired and my parents deemed that going to Canada was better than coming to Pakistan at the time. After we were issued orders to leave Canada, we left voluntarily, but our departure order (issued the day we arrived in Canada) became a deportation order.

Now, I have applied for an ?Authorization to Return to Canada (ARC)? with my ?Study Permit? in mid July. My university is to commence by September 8. The application I submitted contained all necessary documents the High Commission could ask for, was financially strong, and showed my good performance in school. I have been accepted to the University of Toronto. Remarkably, I received a prompt reply from CHC, Islamabad on 24 July stating that I should complete my Medical Exam, but telling me that this did not mean that my file had been approved. Naturally, I immediately completed the medical and am now waiting for further word from them.

1. Taking my history in mind, what do you think are my chances of being approved?

I would like you to note that I was under the age of 18, a minor, and dependent on my parents when I entered and left Canada. This is my main point, which I have outlined in my application as well. And there is no criminal record or anything of the sort.

2. I know having to undergo a medical examination is a positive sign, but comparatively, how many people are denied after having to do their medical?

I have a month left of wait? I hope for the best.

you may have been requested to do your medical simply because of the short time between now and when you school starts.

given your history, CIC may see this as another attempt in a long string of efforts to get into Canada one way or another.

Where are your parents now and what are your ties to home that would prompt you to leave at the end of your schooling? if they are not strong (and how could they be, given your circumstances) you may be out of luck.

My parents are in Pakistan, three sisters are living here (2 married). My parents have property in Pakistan, own the house they live in, my father works here in Pakistan.

hopefully u wilbe approved.........and be positive . we arnt the visa officer to say no to anyone we can just guide anyone and we shud tell them to think positive...dont worry Jaffery everything wilb just fine.

U tried to stay permanently in the USA and then tried to remain permanently in Canada so why would any Visa Officer think that you would leave after a temporary Visa was issued?

I can not win the lottery maybe U can.

Because you were a minor when you lived in USA and Canada, the Visa Officer may juge and decide that you enter Canada to pursue your studies. Even though, it seems unlikely you´ll return to Pakistan BUT there is no reasonable reason to refuse you a visa. YOU WILL GET YOUR VISA.
As for Medical exam: don´t worry this is a requirement for a citizen of certain designated countries (including Pakistan)...yes, your application was not approved but it is about to get approved because they asked for your med ex. it´s like hiring: if you are called for interview, there is a high chance to get a job.

David, you sound pretty confident. Please don´t mess with somebody´s head unless you are actually the immigration officer who is looking at Jaffery´s file.
