Subject: Unique situation
  I have a different and difficult situation. I am an american citizen and my husband is a mexican citizen and we reside in the US. We have 3 young children one of which has a genetic disorder. We are currently in the "legalization" process as he has come into the country undocumented. This is taking a long time. Recently the state I live in has passed some tough immigration laws which will eventually make it impossible for him to continue to be with his family.

We have our own business, pay taxes, etc. We have had to scale back because of fear of immigration. My husband has been in the US for nearly 20 years, and does not have anything to go back to in Mexico. He is a good man, hard worker, and community oriented. He speaks english and has "assimilated" very well as so many seem to want foreigners to do here.

We are looking for a chance to make a fresh start somewhere that we can feel safe. How would we go about applying for a work visa with our situation? He is a well experienced roofer and has farm (dairy experience). Are these types of jobs considered skilled? I do have a AA degree and have been with the same co. for 5 years now. Does that make a difference.

Please know we are aware that of course he did not do the right thing when he entered the country. He was just 16 and the youngest of 10 children, there was literally nothing left for him, but to try to find a better life for him. We really would like to look into migration to Canada, and do things the right way.

You have your own business? Which is?

Does your husband know how to do flat roofs? What is his age?

To obtain a work permit. WP

He would have to apply through Mexico city because of regulation 11 and it could be risky if they called him for an interview. Without an interview it is a walk in the park, almost.

He has to be able to prove three years experience as a roofer. (Reference letters)He also will need proof of no convictions from your state and USA and not Mexico because he has never resided there for six months since 18.

First issue is to find an employer. Then find an employer who has a pre-approved Labour Market Opinion (LMO) or is willing to seek one. Many authorized representatives assist with obtaining a LMO.

Processing fees are $150.00 employer specific WP. For you an open work permit $150.00 for the kids $125.00 X 3 for student permits.

I would recommend he does not go home for the Interview if called for the Interview.

I got my file number 13-12-2006,there is clearly mention time taken at least 48-54 months.now rules are changed.
i just want know about my case also come under new rules and regulation.

We have a small roofing company, mainly dealing with shingle roofs. However, my husband started off doing flat roofs and that is what he does best. He asks what type of flat roof? Experienced in single-ply (all types)and built up.

He´s 34 years old and in great physical condition.

He has been doing roofs on his own (our business) for the past three years. Would we need letters from homeowners in the past years as he is self-employed?

Regarding application for WP:
Does he need to be present to apply? in other words is only option to go back to Mexico

Finding an employer..
does he post resumes on canadian job sites? Suggestions?

Everything is done via e-mail. The visa post will send you an e-mail to inform you to go to Canada since no TRV or CVV is required for you, your kids or your husband.

Yes get letters of references from homeowners and attach a status document or a drivers license to show were they live etc.

Well it is always better to have connections in the construction business. Your husband will know that because most of the new business comes the way of references.

There is always a way when there is a will.

Is this really possible to do on my own, or would it be wise of me to get help from a organization like yours?

Here in the US, it is common for papers to be denied because of minor errors, hate for that to happen to us.

I know you said he had to apply thru Mexico because of regulation 11, can this be done online?

We definately are willing people looking for a way!

Try calgary, they are very short on all people construction and many big companys such as PCL are willing to get visas for experienced workers.
