Subject: Extension of PR and other questions
  Hi,
I received my PR card in Oct 2006 when I did my landing. I left Canada however as I will still working and residing in another country. Since then I have travelled back and forth. I recently spent 6 months here and had my baby here who has received her citizenship and passport. However I still keep shuffling back and forth as my husband, a British citizen works in Dubai and we are not ready to move here for another 2 years.

My questions are:

1. I understand I have to stay for 730 days to apply for my citizenship. I have so far done a little over 200 days. If I return and complete the balance days, can I apply for citizenship. Will I need to be in Canada after completing these number of days to apply?

2. If I do not manage to complete the entire 730 days and my PR card expires, can I renew it based on the fact that I have permanant ties in Canada, i.e. family, property in my name, a bank account? Do I have to be in Canada to renew the PR card?

3. Does the fact that my daughter being a Canadian citizen strengthen my case of renewing my PR card / obtaining my citizenship?

4. Do I need to be in the country to sponsor my husband? Does he also have to wait out the 3 year (is it 3 years??) period to obtain citizenship? Or does he get it immediately if I obtain my citizenship? Is it easier if I apply when he is in Canada or out? Does he just travel in on a visit visa? How long does the application process take?

5. I have misplaced my Record of Landing document? How do I go about reapplying for a copy. I understand I need this for applying for citizenship.

6. And lastly my aunt has applied for a visit visa several times from Dubai, United Arab Emirates and has been rejected. Is there a way to appeal with the Canadian Government here? How can she atleast come for a visit? And what about sponsoring her? Can I sponsor her or can my mother (her sister) sponsor her? What are her options, she is 59 years old.

What is the residence requirement?

To be eligible for Canadian citizenship, you must have lived in Canada for at least three years (1,095 days) out of the four years (1,460 days) preceding your application.

Please note that you cannot meet the residence requirements for citizenship without a minimum of two (2) years as a permanent resident.

When calculating your time in Canada:

only the four (4) years preceding the date of your application are taken into account;

each day you lived in Canada before you became a permanent resident counts as half a day;

each day you lived in Canada after you became a permanent resident counts as one day;

time spent serving a sentence for an offence in Canada (e.g. prison, penitentiary, jail, reformatory, conditional sentence, probation and/or parole) cannot be counted toward residence - there are some exceptions to this rule;

absences from Canada may have an impact on your residence. Only a citizenship judge can determine if you meet the residence requirements with fewer than 1,095 days of physical presence.
