The CIC specifies the followings as relatives:(cut and paste)
Relatives in Canada
You, or your accompanying spouse or common-law partner, have a relative (parent, grandparent, child, grandchild, child of a parent, sibling, child of a grandparent, aunt or uncle, or grandchild of a parent, niece or nephew) who is residing in Canada and is a Canadian citizen or permanent resident.

(in reply to: Sister in law is a canadian national ,can i claim) if your brother is also a Canadian Permananat Resident then you can get the points because it is the brother that would qualify you for the points. If your sister-in-law is a canadian national and your brother is not even a PR then obviously your brother is not in Canada. I dont think in this case you will get the points.
