Subject: Change of Marital Status to PR Application
  Hi,
I have applied for canadian immigration from here in US and waiting for the interview date which is so far not announced at least till march 1st, 2005. I am in US and an indian by citizenship. My interview will be scheduled at Los Angeles office. I got married 6 months back in india, and my wife came to US 1 month back. Now i would like to add my wife to application, in this scenario I have following questions,
1. whom should i inform about change of marital status?
2. what happens if i inform canadian consulate about my change of marital status?
3. Do they cancel my application and ask me to do the new one since my interview is scheduled(Date not confirmed though)?
--- Or else they add my wife to my application and send her the interview letter?
4. What are the chances of my interview of getting delayed if I inform the consulate about change in family status?
5. How should I inform the change in status? what documents are needed to send them or fee etc.? Any website link?

I am scared that my application will be cancelled and have to do the process again(it took me more than an year already).

I would greatly appreciate for your help.
Thankyou
Venugopal

Hi Venu,
Ur case is same as that of my friend who came to the US on a work permit and later got married to someone in India. He didn´t inform the authorities on his status change as his had his interview scheduled. Go ahead with interview and when u get Visa stamped in ur passport ask ur wife to go back to India and write a GMAT exam. Based on her line of study, get her admission in some Canadian college so that she gets an I-20 for visa purposes. Once she is in Canada, go for a registered marriage as both of u will be holding a legal status. In addition to that u may like to consult some immigration lawyer in the US. Disclosing ur marital status will only delay the process by another 6-8 months.

i am concerned that withholding your change in marital status would be considered false information with CIC. I would check with an immigration lawyer on the best way to deal with this. you may need to sponsor her once you are in Canada. I am sure this happens all the time and there is a correct and honest process. You do not want to have your immigration disallowed for several years because you were trying to save yourself a few months.

I do not think that you should withhold information about change of your marital status. Do you really want to go to Canada without our wife?
Inform the immigration asap and your might be able to add you wife to application.
That process would be much faster then actually going to Canada alone and then applying for your wife. It might take longer to get PR since you are adding your wife, but hey at least two of you will be together. Think about it. Even if you do not plan to add your wife to application NOW, you still have to notify the immigration about your changes to marital status.

Hi,

You definitely need to inform the Canadian Consulate handling your permanent residence application about your change in marital status, as soon as possible to minimize the delay you experience. If you don´t inform now, you will have to inform them before you send in your passport to be stamped with your visa. That is one of the things they mention in the passport request letter - that you must inform them about a change in marital status before you send your passport for visa stamping, because if you don´t you may deemed inadmissable to Canada when you attempt to land. And on the off chance you don´t inform them and aren´t deemed inadmissable, you may have a problem sponsoring your wife because they may question why you did not simply include/add her to your PR application since you were married before your PR status was granted. You can either choose to include your wife with your PR application or you can chose to land and then sponsor her at a later time. Either way you need to inform CIC about the change in marital status to avoid any complications/problems. I believe the only way your application will be "cancelled" and you´d have to begin a new application is if they deem you inadmissable to Canada after your passport has been stamped with your visa OR if you fail to land before your visa expires.

I´m not sure exactly what you need to do, however if you still have your Acknowledgement of Receipt letter from Buffalo I believe they provide the information you need to contact them as well as a form you can use (if you so chose). You should probably include a copy of your marriage certificate when you inform them about your change in marital status. I can only assume once they receive this information from you, they will contact you as to what documents/information they need and send you any forms you need to fill out.

As for fees, if your wife is going to accompany you to Canada, I´m sure Buffalo will inform you as to how much the fees are (if I had to hazard a guess I would assume that they would be the same amount that you had to pay).

Hope this helps a bit.

my case was exactly the same as yours I informed them and they waived my interview and asked me to submit processing fees and marriage certificate etc, it will be in your best interest to inform them, best of luck
