Subject: ROY & Others ITS IMPORTANT!
  Hello,

My dad´s H&C application is in process, sitting in Scarborough. However, my dad is now very upset because of this uncertainity and he wants to leave and go back. His visa is still valid for one more year (recently extended).

I need your advice guys. If he leaves what what would be the status of his application. I am planning to submitt a regular sponsorship application next year, should i withdraw the H&C when he is leaving the country. Should i inform CIC Scarborough that my dad is leaving or has left.

Please advice as this will set my future course of action.

my guess would be that him leaving Canada would pretty much kill your H&C chances.

Yes, i agree with you Sharon, and that is why i am planning to file regular sponsorship application next year. I want to know if i should inform CIC that my dad is leaving or jut let it go with the flow?

Mike sorry I missed this!

Mike when one applies under H&C IRPA (25) they are applying for Landing from within Canada.

In theory if the person leaves or even if the person is removed and the CIC officer that needs to finish the application regardless this outcome is possible.

They can find the applicant he/she will be allowed to return to Canada Stage One approved. Only know of one such situation but it is possible.

In my case i do not know if it is stage one approved or not because file is transferred to Scarborough. I do not know if i am right but i heard that if first stage approval is granted from vegreville and if the file is transferred to local office then that means that file did not receive the first stage approval. My question is still not answered, should i inform CIC about his departure or not?

Pick up the Sunday Sun I got told my clients will get front page unless something else major happens. They have been waiting for Scarborough to react since April 23 2003!

Granted on October 18th 2005 their H&C file was transferred to the PRRA unit for risk assessment. I wrote nothing about risk.

Your not stage one approved you would of received that letter and it would say to provide a whole bunch of additional documents. It would only get transferred when your dad is ready for Landing.

No need to inform Scarborough just submit an outside Canada application. Let Dad be happy hanging out with his friends away from you for a while. Your stress is probably causeing him stress.
