Subject: Help! How to save my PR status.
  Hi Friends,

I am a Permanent Resident of Canada, working as a medical resident in US completing my residency. My PR card expires in 2010. I am doing a 4 year training in US in order to work in Canada. But according to Canadian Immigration Law, I have to spend atleast 2 years out of 5 years in Canada in order to maintain my PR status. If I am spending 4 years out of Canada, is it really going to effect my PR. Also, before starting residency, Health Canada issued me a letter stateing that since there is shortage of doctors in Canada, they allow me to get training in US so I can come back.
Does anybody know what to do here?
I would appreciate if anybody can help me in this regards.

You only can stay more than 2 yrears while maintaining your PR status by;

EITHER:

Staying with your Canadian citizen spouse.

Working for a Canadian company/Govt.

Staying with your Canadian PR spouse who is working for a Canadian company/Govt.

I don´t think that the Health Canada letter will work if you work for any non Canadian agency.

So, if you like to maintain the PR status then have to visit and stay Canada to meet the 2 years requirement if can´t fulfil any of the above stated conditions.

Read the regulations carefully regarding residency or search here you will find if your outside Canada working for a Canadian company on a full time basis it is not counted as time outside Canada.

There are plenty of engineers who went back to their country after receiving status and starting up their own company ( themselves ) and worked as consultants on projects etc.

That should bring a smile to DC!

That is about all I can say on this subject.

You have to do your 2 year time Canada otherwise you will lose your PR.

I smiled Roy. For a different reason though. Many guys establish paper company in Canada use to work for them while safely over statying overseas. I don´t know the details as I would never have the mentality or need to do so, but it is a well known open secret.

where are you in States? If you are close to any border city like Niagara falls, windsor, or sarnia or any other canada/usa city, then you can rent house/apartment in canadian city and you can cummute on daily basis, so you don´t have to loose your PR.

The last option is the safest one with no problem at all, only catch is Mr. Faraz has to find a residency in Detriot or any other closer city from where he can commute to Canada daily. It is 100% legal.
