| Subject: deportation from US back to Canada after felony pl |

My son-in-law is a Canadian citizen. He has been in the US for about 18 years. He has a perm resident card. Recently he was advised by an attorney to take a felony plea after being accused of a crime. He took the plea not realizing or being advised of the consequences. American INS picked him up and he is in jail awaiting deportation. INS is saying they are waiting on Canadian authorities to ok his reentry. Can I get more info on this subject, please?

Canada deports many people from other countries due to them having a criminal conviction. Regardless of how many years they have lived in Canada.
So if he can appeal his conviction by all means appeal.
Too many of my clients have been told to take the guilty plea you will only get probation to have CBSA take them to a hearing to have them ordered deported.
CIC has an appeal process for PR´s and I would assume USINS has an appeal type process for Green Card Holders to.

Thank you for your reply. We know INS has an appeal process, however we have been told the appeal takes years and they will hold him in jail all that time. My main question is...does Canada have to approve him to return to his homeland of Canada? He is a Canadian citizen with a green card in the US.

No Canadian has to be approved to return to Canada. Canadians, First Nation People who are registered and PR´s who have complied with their residency obligations have the right to enter Canada.
