Subject: do I keep reapply for visitor's pass while...
  I´m an American married to a Canadian. I´m currently applying for an extension of my stay in Canada while my application for Permanent Residency is being processed. Do I keep renewing my visitor´s pass while I await for my Letter of Approval? And can I do this at the border or do I need to keep filling out the "Extension to Stay" application, and paying the $75 fee? Please help! Thank you so much!

If I were an American, I wouldn´t care for anything....

Sure that you have to pay fees and everything, but for US Citizen thats a piece of cake....

Hi,

For starters, is your application being handled Inside Canada or Outside Canada? And what sort of application did you submit (i.e - spousal sponsorship, common-law sponsorship, skilled worker, etc.)?

If it is being processed inside Canada (and since you´re residing in Canada) contact CIC and see what you need to do to apply for a change of status. Basically with applications processed within Canada, once you receive your Approval In Principle you can then apply for a general work permit (which is granted by applying to change your status from visitor to worker). I´m not sure the exact forms and whatnot you´d have to fill out though, since my application for PR was handled outside Canada.

If it´s being processed outside of Canada (by the RPC in Buffalo since you´re American) then your best course of action is to continue applying for visitor´s visa extensions paying the $75 fee. If you´re going to be applying for an extension soon, I recommend asking if they can extend it for a year (reason being so you can remain living in Canada while your PR application is being processed without having to worry about extensions during the process) - you could include a copy of your Acknowledgement of Receipt to prove that you have a PR application currently in process. They may simply give you a six month extension despite you asking for longer.But basically it can´t hurt to ask them to extend it for a year...nothing ventured, nothing gained.

Oops, ignore that second question. Since you´re married to a Canadian, I can only assume that you filed a spousal sponsorship application.

One thing I forgot to mention in my previous post was that you could try simply getting one at the border, I talked to one person who extended her visitor´s visa this way...but in my opinion it´s a bit risky to attempt this, the only time I myself would do it was if I forgot to apply for my extension and needed a new visitor´s record to remain in Canada with my husband.

FYI - I´m American. I married a Canadian in October 2003. In July 2004 we sent my completed application for permanent residence as well as my husband´s application to sponsor me to the Mississauga CPC. On August 6th, Mississauga approved my husband as my sponsor and forwarded my application to Buffalo for processing. On October 6th, Buffalo sent out my Acknowledgement of Reciept and on Decemeber 20th they sent out my passport request. My visitor´s visa expires on January 20th, and since I didn´t receive my passport request until December 30th (gotta love the delays in the mail due to the holidays, but it was a great way to start the new year!) I´d already sent out my request for an extension to my visitor´s visa. Hopefully it´s approved, if not I´ll be landing a lot sooner then I was originally planning.

If you don´t mind me asking what is your timeline so far?
