Subject: Can I get this con artist deported???
  Hey everyone,

My sister is in trouble.

She, a Canadian citizen from birth, had married an American man four years ago and they have been living here in Canada ever since. He has never pursued a Canadian citizenship application or ever applied for a work permit. He has never lifted a finger to help her out financially and as a result, has bled her dry, so to speak. He is now asking, through her, for my parents to bail them both out of certain bankruptcy. He is a freeloader and a con artist and he has my sister brainwashed into believing he has done nothing wrong.

Thankfully, she does want to separate from him (because of fidelity issues), but he still has her feeling sorry for him, so she?s in no rush to call things off completely until she can scrape together some money for him to go back to the states. Talk about a piece of work! My sister is now begging my parents for thousands of dollars to help him out, but they are afraid of what might happen when they reject her proposal.

He?s got his hooks so far into my sister, there is a concern that she may allow him to hang around indefinitely, continuing to leech off of her and the rest of my family. If things don?t change, this will tear my fragile family apart.

Is there any way to get this slimeball deported? I?m not positive on the conditions of his arrival, but I?m pretty sure his original intent was just to visit my sister temporarily. He never wound up returning to the States. Also, he has admitted that he has a number of unpaid debts waiting for him in the US, as well as a couple of children that he abandoned eight years ago and has never supported. Like I said, a real scumbag.

Is there any legal action my family can take to send him back to the US and get him out of our lives for good?

Any advice would be GREATLY appreciated, as we are getting desperate.

I appreciate the CBSA info, Roy - thanks. However, I wonder what my chances are of reaching someone who would actually care that much. I´ve read so many articles about an uncaring immigration ministry that lets creeps like this get away with everything. Plus, my past inquiries with govt agencies have left me a little cold.

Is there anything, based on what I´ve revealed here, that stands out as incriminating at all? Is this an obvious case of immigration/marriage fraud? Or is there little hope in resolving this legally? Is there a particular element of his being here that I could investigate safely on my own?

Again, thank you in advance for any and all responses!

if no application to sponsor has been filed with CIC by your sister, the husband is in Canada illegally - period.

if he has his permanent residency, then he would be entitled to work and that becomes an issue for your sister and he to work out. If his application is in process as an Inland Sponsorship, he would be allowed to get an open work permit until the sponsorship process completes - it does not take 4 years so I suspect it has not been done.

marrying a Canadian does not automatically entitle you to legal status in Canada so this may not be marriage fraud. More like a case of marriage mistake.

biggest concern I would have is the safety of your sister.

Thanks Roy and Sharon,

I believe I now have a better understanding of what may be happening here. I also feel better equipped to talk to the authorities. I´ll be contacting the CBSA, and if necessary, an immigration lawyer.
