H and C or Refugee?

Subject: H and C or Refugee?
I am on a visitor´s visa to Canada. Can I claim Humanitarian and Compassionate grounds instead of Refugee. I do not want to claim refugee. My parents are old and sickly in Canada and they needed me to care for them. Can H and C work in my case?
Please answer.

Hi Roy,

I do not want to claim refugee because I was well off in Ecuador, I was a former Customs Officer.

I want to look after my elderly parents. Can I apply for a Work Permit whilst my H and C application is in progress?

People can apply for anything but you will not get a WP until your stage one approved.

I would like to know your grounds for an H&C or a Refugee claim it might be interesting.

Hello Roy,
Thanks for your prompt reply.
I am not claiming Refugee as I have no grounds. I want to claim H and C as I mentioned in my first posting.
I want to take care of my elderly and sickly parents in Canada. They depended on me as some uncles and aunts have abandoned them. That is why I gave up my job to take care of them. They cannot return to Ecuador because of their medical care in Canada.

how long have your parents been in Canada? were they sponsored? CIC will likely ask those questions first.

why not try to extend your visitors visa?

Roy, thank you for your advice.

Sharon, my parents are citizens and they have been in Canada for about 20 years, now they are in their late sixties. They came as skilled workers when things were easy, that is they got through in two months, that is 20 years ago.

I have already extended once, and it would be expired in one month time.

Roy, what do you mean by Stage one approved? How long would stage one take?

Go to www.cic.gc.ca and search for Operational Manuals. Then look for InLand Processing, then IP5 and read the H&C manual it will explain the two step process.

All H&C applications have to be based on common sense. The key is Chapter 6.7 of IP5 which states the hardship must be beyond your control.
