  I know CEC is a fairly new initiative and there might be many out there with questions unanswered. But was wondering if any of the immigration gurus could help me out here ...

The CIC website says : "As a temporary foreign worker, you must have two years of full-time (or equivalent) work experience in Canada." and then defines Full-time work experience as "working at least 37.5 paid hours per week".

Some quick math says, this means 37.5 hours x 52 weeks x 2 years = 37.5 x 52 x 2 = 3900 hours.

Now, I have one job (in NOC Skill Type 0) but have worked more than 45 - 50 hours per week in that job. In effect, I will be reaching 3900 hours in about 1 year and 8 months, given the overtime I have done every week (and got paid for it) ...

I hope you get my drift ... the obvious next question is - will I be eligible for applying through CEC under such a condition where 3900 work hours completed in less than "two" years in a valid full time job ?

To those thinking, why not put in 4 more months and make it 2 years round ... well, I might not be working beyond 1 year 8 or 9 months with my Canadian employer ... and sadly so, will have to leave the country after that. But whether I should apply for PR through FSW or CEC is the question I am fiddling with.

Any insight (if not definitive answers) will be very helpful.

I don’t know the answer to your question for certain. Perhaps someone else can shed some light on this. Roy?

I see two contradicting statements, hence I don’t know which one would be correct.

1) According to the CIC website (http://www.cic.gc.ca/english/information/applications/guides/5609E2.asp), under Experience Requirement:

“You must have obtained the equivalent of two years of recent full-time or full-time equivalent (one week is 37.5 hours of work) Canadian skilled work experience at NOC Skill Type 0, or Skill Level A or B. This work experience must have been acquired in Canada (within the three years preceding the date the application is made*).”

I would read “full-time equivalent” exactly how you read it. Hence if you have the required number of hours completed in less than 2 years, its still 2 years full time equivalent.

However,

2) On Canadian Legal Information Institute’s website (http://www.canlii.org/ca/regu/sor2002-227/sec80.html), its states:

“(4) A period of work experience that exceeds full-time work in one occupation, or simultaneous periods of work experience in more than one full-time occupation, shall be evaluated as a single period of full-time work experience in a single occupation.”

So from that I would gather that any extra hours worked in a year will not be counted. However, note that the above criteria applies to Federal Skilled Worker category. This regulation may not apply to CEC. I was unable to find an equivalent regulation for CEC. So I am not sure if the same would be applied to CEC as well or not.

Perhaps someone can comment on this.

P.S. I understand the situation you stated. But if you can try your hardest to make it to 2 years, that may be less risky. Can you go back to school for 1 year perhaps? I dont know what other solutions there might be, but something to look for.

i am in the same situation worked less than 2 years and did a lot of over time and i asked on another forum

i received the answer: you should be working at least 2 years .so we have to wait to be 2 years and after apply .

Im a temporary contract worker here in Canada for almost 2 years now, im a worker in the hotel (housekeeping)bt i dont know what category I belong , (skill type in the NOC) am i qualified after 2 years , could you please shed light on me in this matter....pls

I have a questions regarding eligibility for CEC as well.. I have a fulltime MBA which I completed last year (2009 May) it was a one yr. degree program and now I am working as a Manager in one of the top 5 banks. I will complete 1 yr full time experience in Canada in July 2009 and was wondering if I will be eligible for applying for under the CEC class.

Hi, I started my job in 27th May 2009, Can i apply in the end April 2010, Is one year experience requirement fulfilled or should i have to wait till 26th MAY,2010? Canadian immigration calculate the 1 yr experience till the application submission date?

Hi Everyone,

I am new here. Please advise me on the following question:

I have done my B.Sc from India and M.Sc from Canada. I can easily get the official transcript for M.Sc from my university in Canada. But I was wondering if its fine to photocopy and notarized my certificates from India for my B.Sc and end it along with my application ?

Dear Sir/Madam,

I am Foreign worker in Canada and I work 3yers for Boston Pizza as a cook.I did IELTS exam two times but I couldn´t get required score for Canadian Experience Class.

Under a open work permit,my wife woke for Sobeys
as a cake decorator for two years.She has 3yeas cake making and decorating diploma as well.She is going to do the IELTS test .
I would like to know that if she get band 5.5,can she go for the Canadian Experience class as a principle applicant?
