can i apply for Humanitarian and compassionate considerations if:
1. my passport expired ,no valid any more? i ´m in Canada long time.
2. if i will be refused after sending my application, how much time i have to leave Canada, does they will arrest me and deport me? or can i have a option to leave voluntary?

Passports can be renewed, even if expired. Why would that be grounds of humanitarian and/or compassionate reasons to allow you to stay in a foreign country?
What major problems would you have renewing a passport? Call me stupid, but that must be one of the worst reasons I have ever seen to ask for H&C application, because you cant be bothered to renew your passport?
What would people think up next?

In the required document list for all H&C applications it states that the PPT is suppose to be valid. http://www.cic.gc.ca/english/pdf/kits/forms/IMM5280E.PDF
Please understand that normally CIC send out a basic form letter when they transfer the file stating that you must have a valid PPT.
Now Ivan who may have been here since 1989 knows that if they do not have a PPT it will be difficult for CBSA to send him home. Ivan is probably concerned regarding the time he would be given to dispose or sell his current belongings if he receives a negative decision.
Just a guess.

You mean to tell me that if I move to Canada, manage to “lose” my passport, I can then stay in Canada and even become a citizen one day? Damn, now why didn’t I thought of that before spending money and time to apply for PR.
So I really am stupid.

My client Hong Zhang had no passport when she was approved stage one in February 2008. I had her apply for her PPT and when the consulate issued same they took her in the back room to almost apply hot coals like in "Iron Man". All for embarrassing China during the year of the Olympics.
Certain circumstances like a In Canada spousal sponsorship a PPT is not necessary!
Some new countries like Kosovo have not even begun issuing passports at all.

they asking for valid passport to have less problems to send me back home,less spending and time to keep in jail.
Ray Masa - 1. please tell me how can i renew my passport if i´m illegal here?
expired passport is not a ground to apply for H&C everyone knows that , my ground for H&C is risk for my health back home, so now i have 2 choices 1.to stay in Canada illegally but healthy or 2. go home , live on contaminated radiation land , possible to get sick with cancer and died.

Ivan go to your countries Embassy or Consulate and if you have indeed been here for years you know that.
No one at CIC cares about your land back home even if it glows in the night. Your radiation covered land is not a reason to show compassion.
You need to show Unusual and Undeserved Hardship not anticipated by the IRPA & IRPR and in most cases beyond your control!

the embassy will ask you for a valid status in canada to renew your passport , they can actualy renew the passport if you have a letter from cic, cbsa don t need a valid passport to send you home if the flight company agree, but if they want to send you home they gonna arrang with the embassy to have an one way extention of your passport ,or a travel document.........

How can you say what a fictional countries passport renewal conditions are?
If I was Canadian in France and my passport expires while visiting Paris I would be really pissed if the Canadian Embassy in Paris refused to renew my Canadian Passport just because I violated Frances Immigration rules.
Each country has their own requirement to renew their citizens passports.
CBSA does need valid travel documents to remove most citizens from almost all countries.

thanks again Roy for you honest answer . what i´m learning about my situation i have only 1 option - to stay in canada little bit longer , work hard , save money ,and maybe 1 day go back home and apply for skilled worker program,if i´ll get refused at least i have some money to buy a house on better land.
1 more question: can i apply under skilled worker program from here, and when i will get interview date then i´ll go to my country, i know in my application i have to tell them i´m in canada illegally , do i´ll get instantly negative answer from CIC?
or should i ask some one to send documents from my country,and not to tell them i´m in Canada?
to tell the true or lie , what is better for me i don´t know

Are you serious? Tell the truth or lie??? You are asking us if you should lie??
I´m sorry but you are in this country ILLEGALLY!! I don´t think you should have the option to ´stay and work hard and make money to build a house in case you are kicked out of the country.´ Rules are rules, and you should be abiding by them!!
Sorry but this kind of blatent disregard for the law pisses me off!
