Subject: What is the best option for us?
I live in Canada, have citizenship, passport and whatnot. My girlfriend lives in the US and we both decided that she´s moving in with me. Right now she´s going through a divorce and I was wondering when the divorce is over. What´s the best option for us to be together? Apply as conjugal partners or something else? Also how long would this process take before we can be together? I´m currently studying at the moment and plan on living independently once i get a stable income. Also would sponsorship be a better option rather than conjugal or are there better options for us? Would she or I require to travel and visit from time to time?

you need to give this conjugal thing a rest and have fun together. She is coming from one failed marriage straight into a new one, which is likely to fail unless you both first realize there is more than mating to life. Enjoy her first and see if both of you can stand each other after farting and what-not.... Seriously.

Ok, but is it better for her to get a visiting visa to visit me or is it better for me to visit her? See how this goes.

If she is coming up to visit, she will not be able to work, thus you will need to support her entirely.

To move to Canada as a PR, she will either need to come as a skilled worker, or you will need to sponsor her ~ either as common-law after living together for a year or if you get married. Conjugal is very difficult to prove as there needs to be some sort of impediment such as political unrest, etc. that prevents you from being married or common-law. You may want to check the immigration laws in the US and see if there is an option for you to go down and be with her there.

living together as in the same house i assume in Canada? How is that gonna work cause i don´t think they´ll let her visit and stay with me for a year or can it be broken down like 6 months in 2009 and the rest in 2010?

You could live 6 months in Canada, 6 months in the US, then 6 months in Canada. Nobody said it would be easy or ideal, but this would meet the criteria.

If she tries to live for 6 months in Canada then would she just need a passport or more than that?

You need a passport to fly into Canada. If not now, then very soon, you will also need a passport to cross by car into Canada. Gone are the days of coming into the country with just a birth certificate and driver´s license.

Ahh, is 6 months the max amount of time you´d stay in Canada and US with just a passport?

passport is not the issue... maximum length of stay for anyone as a visitor is 6 months. so, you either illegally overstay, or leave and attempt to come back to begin the 6 month clock again. if border officials feel like she is living in Canada on a permanent basis, they will not let her back in the country.
