  To All

Thousands of Permanent Residents who are NOT actually residing in Canada will be having their PR card cut into two, real soon! We have had hundreds of postings here at Canada-City about residency requirements and the (730 day) issue has been explained, again and again. Probably thousands will be learning in the next few weeks that they are no longer Permanent Residents!!!!

Persons (PR´s) who have stayed out of Canada to keep a high paying position in a country that requires them to have a work permit/residency permit in their passport will have the most difficulty. Bogus residents working in the Gulf States will be affected mostly.

Those that have returned to their country of origin and were never stamped into that country will have less difficulty. It depends greatly on what you say at the Port of Entry upon your return.

Then there will be plenty of non-residents who will easily beat the system and be able to get their PR card renewed.

Proving one has (NOT) been PHYSICALLY PRESENT IN CANADA is not that easy as it sounds.

When one wants to turn the system in their favor and they research the Immigration regulations it is not that difficult to find ways around the rules. Anyone can start a Canadian company and employ themselves as long as the company and they are paying taxes all should be well.

Then there are other ways!

Is explaining how to make it appear one is residing in Canada for a fee acceptable?
Is explaining what CIC will be looking for on most PR Renewal Card applications for a fee acceptable?
Is explaining what some others have done to beat the system and got their PR Card renewal for a fee acceptable?

Here is a grey area of the Law.


Or is it (for a fee) that upsets one?

Or is it that these persons used Canada and never were Permanent Residents is what upsets one?

Before we condemn others we should walk a kilometer/mile in their shoes.

Many could not wait for that good paying position.
Many could not get their credential recognized.
Many could not obtain that required Canadian experience component.

When it comes to being able to feed ones family residency must take a back seat!

Lets look at the former regulations in that one had to be in Canada 183 days in any twelve month period. Again the issue was days but some claimed six months. CIC Officers had to show that the person intended to abandon Canada as their place of Permanent Residency if they had remained outside of Canada in excess of 183 days. Proving one is PHYSICALLY PRESENT or INTENDED TO ABANDON Canada as their place of Permanent Residency is how to beat the system.

Think about this statement for another second, "When it comes to being able to feed ones family residency must take a back seat!"

Hundreds if not thousands working abroad so that they can feed their families will lose their PR status. FOR WHAT??????

If I find a man or woman who has been residing OUTSIDE of Canada so that (they can feed their children), I would gladly assist them in maintaining their residency by any legal means or represent them at the Immigration Appeal Division or worse case scenario assist them with a spousal sponsorship so they can obtain Permanent Residency in Canada again!!!!



Yeah I know I feed my family by helping others!

I can also pick and choose who I take as clients.

Do you not see that common sense must prevail in this world global employment market? What is the purpose of taking away ones residency when their spouse can easily sponsor them back?

A little disjointed with much hyperbole, Roy, but the information is interesting and pertinent.

I assume you´re saying that residency status is at risk for those PRs having stayed more than 2 years outside of Canada within a 5 year period. And that those who do so thinking they can keep their status by attempting to "game" the system due to lack of passport stamping etc. are at risk. I agree, and these deserve to lose status.

But I don´t think the regulation or intention is to prohibit PRs who abide by the rule from taking temporary employment outside of Canada during the allowed 3 years. Those PRs are not at risk, whether they have work permits papers attached to their passports or not, so long as they return within the maximum 3 year time frame.

Just to make it clear.

Hi !!

I applied for my PR card renewal in June 2008....having said that my PR card expired in March 2008 and I had not completed my 730 days. In October 2008 I recieved a letter from CIC that they have reviewed my case and send the file to the Toronto office for further review which will result in further delay. I called the CIC hotline to find out the progress and the agent said residency reviews could take upto 18 months. Can someone provide me any insight on residency reviews? How min/max how long do they take? Should I contact the local office for the status or just wait to hear from them.

Just won a vacation dispute regarding two persons found to be CR´s it took 18 months.

Have another Vacation Dispute where then think my client is Kenyan instead of Somalia that has been seven years.

My PR was up for renewal in Jan 2008, I aplied for renewal in Feb. 2008 with a RQ questionare, because I hadn´t made the 2 year residency requirement..I made about 13 or so months. I came back in April 2008 to my husbands place work in Middle East. And now I am in a difficult situation. My daughter is in Halifax, Canada studying at Dalhousie University, but she is very sick and I need to go and see her urgently..but I am not sure whether to apply for travel document and if so will I be given a TD, The CIC says that my file is is still in review...but I need to be with my daughter urgently...please advise.

Hello,

My boyfriend had his PR then went to his home country. When he returned to Canada, he applied for PR again, which he received in surprisingly short amount of time. In February he got a letter saying he had not completed his 730 days in Canada. He knew he would not be able to complete the 730 days rule when he returned, and thus he applied for a NEW PR...but Immigration simply renewed his old PR. He is now in his home county, and immigration says it will take 10+ months. Is there any way we can fix this mess up?

hello to all ...who are going to help me with this :(

I applied for PR card renewal in april 2009 (on H&C grounds...because at that time ...i was short 9 monhts in order to complete 730 days requirement)
after long wait of 10months...my local CIC office asked me to come for interview. But time still refused to favour me ...and i could not make it to the interview date. So, as mentioned in the CIC letter ...i went to their office and filled another form (request form) explaining the reason for missing the interview date and requested them to accomodate me for another available date.
Unfortunately ..till date no word from them.
So today ...i went to their office to ask if they still have my file open and approximately when would it be possible to get another call for interview.
Came to know that the officer who deals with PR card renewal applications is on vacation till august ...so i have to wait till august to know if i get another call or if my file is already closed ..and i need to apply from start.

now the confusing part...

my interview letter says that if they don´t hear anythin back from me within 180 days ...they will close my file and i have to apply form start with new application form. And 180 day period will finish next week.
As now i know ..tht i won´t hear anythin on my application till august ..and nobody in the office will tell me the status of my application (online it says "in progress")
I don´t know if they consider a "request form" ..as hearing back from me !?
as i didn´t get to talk to any concerned immigration personel....just the front desk help.

AND i cann´t afford to wait any longer ..because i need to travel to US for my studies and then come back and travel again.

* at the moment ..i fulfill all the PR requirements
* my PR status has never been revoked
*my previous H&C grounds ...don´t apply anymore

queries that i have:

1. if i send a new application (urgent travel...i already have my flight ticket and the payment proof) will that be alright ?
(as i understand doing this ..would automatically close my previous PR application )
am i right ?

2. i´ve already send in my PR card with my previous PR renewal application(H&C)
So will that be alright if i write a cover letter mentioning my file number ..client ID and that my PR card was already send with previous application ...will that be alright ?

i can not afford to cancel my travel plans ..because i have my exams scheduled in US for august and then later in october.

i would really appreciate any advice that you folks have to offer on my situation.

I am a pr card holder in canada. I recently kept my family in canada and support them from gulf. I am doing business in gulf.Now my wife and kids can complete their 2 years pr card renewal requirement. But i will not be able to since i dont want to loose my business which is set up with hard effort in gulf. What are my best options to keep my residency status and be with my family at later stage. i have 2 year and 8 months left. In future my wife or kids could sponsorme in family class. Will there be any objection if i loose my pr status now.
will it help me if i start a business in canada and pay tax

you must be physically present in Canada to fulfill your residency obligations. Starting a business does not resolve that challenged and the government is becoming far more strict in this matter.

yes, you wife will be able to sponsor you in future as long as you can prove your relationship is genuine and enduring and not simply for immigration purposes.

Why not have your family live with you in the gulf?
