Subject: A question about temporary work permit..
  Hi all-

I have a permanent resident PR application at Buffalo. I reached the final stage (medicals done, submitted, and received in Buffalo). I am waiting now for the passport request letter.

I also have a job offer which should start July 09.

If my PR application takes longer than expected and in order NOT to lose my job, can I apply for a work permit/visa while my PR application is still in process? While I am on my job at Canada, I will contiue waiting for my PR.

I read on some postings that the answer is YES..but my question is should I reveal the fact that a PR application is under processing when I apply for my temporary work permit/visa?

If yes, how can I show the dual intent ? Dual intent: intention of leaving the country after finishing the contract (as required for the temporary work permit) and the "hidden" concurrent intention to reside permanently in Canada based on the PR application. It seems that the two applications contradict each other.

This is just a precaution. I hope I will hear from Buffalo soon and I will not go through this. I appreciate any input.

You visit at least 3 forums that I have seen you post in. There have been discussions in all of these forums that its never a good idea to lie to CIC. And yet you are asking if its ok not to tell them that you have applied for PR?

You think that Canada or CIC is so backwards that they dont have computers? That they dont track every application? That as soon as they enter your WP application in their system they wont get a history of all your previous applications to CIC?

Or is it that you think that people working at the CIC are so stupid that they wont notice your previous applications?

Just curious as to what promoted you to ask if you can lie to them?

And to answer you original question, yes you can apply for a work permit. Canada much prefer that people they are granting PR to have a job in Canada. So I dont think they are even going to question you about your dual intent. I think they would be quite happy to give you the WP. Unless of course there is a problem with your PR and they dont think you are going to get it. But at the stage you are at, I doubt thats the case. I also think you are probably going to get the PR before your job start date.

Thanks for the response.

I understand how the system here goes very well.

There is nothing to indicate in my question that I want to lie, as you thought. If there is a clear question about PR, I will definietly answer YES without hesitation..(I just found out in their application that there is such a question. If I had found this earlier I wouldn´t ask). My question was If there is no such a question on the app., I was thinking to reveal it on my cover letter to help them locate my file for their preview..Presence of a PR file may even support TWP app as the PR file will show info that the officer needs to know.

People usually post their inquiries on many forums to get different views, opinions, and experiences .
