Subject: Expert please advise on my PR application
  Dear All,

My PR application is at Seattle office and it is in final stage (medicals done 4 months ago, submitted, and received in Seattle office). I am waiting now for the passport request letter and right of permanent resident fee from Seattle office.

My questions are:

a) In the next month end I am going to my home country for my own marriage and returning back to Canada after 2 months. If I get any reply from Seattle office between my vacation period and if they ask me to submit my passport within 30 days. What I have to do and If I submit my passport after 30 days mentioning I was out of Canada. Will if affect my PR application?

b) After the marriage, can I sponsor my wife on temporary visiting visa based on my temporary work permit visa (During my PR process)?

Please help on above questions or advise.

If you get married before landing as a PR, you have to include your wife in your PR application. Failure to do so will mean that you will not be able to sponsor her at a later date and also your PR status may get revoked due to misrepresentation.

a.) Yes, you can delay sending your passport but you still need to include your wife before the visa is stamped on your passport.

b.) Yes, she can come to Canada as spouse of a person on TWP but it depends whether her visa gets approved.

Thanks Samm for the useful information given to me.

a)In that case my PR process will delayed. After inclusion of spouse in my PR application, any idea how long it will take to get the PR?

b)Rejection of TWP visa is depends on what factors, so that I can prepared accordingly.

a) Your wife will be asked to undergo medical examination and background and security checks will also be done. It should take about 3-4 months at the least.

b) If you already have TWP, then main concern for your wife´s visa would be, if your PR application fails whether you will return to Canada.

Can you please explain in detail? I will be very grateful to you.
a)What I understood that after inclusion of wife name in PR application, I need to do all the process what you mentioned. Means that there is no need to apply wife´s PR application separately. Both applications process will take 3-4 months for getting PR. Am I right or wrong?
b)My TWP is having another 1.5 years from now. In that case, am I eligible to sponsor my wife on visit visa to Canada (During PR process)? or I have to wait for PR applications results. What is meaning of ?if your PR application fails whether you will return to Canada?? I didn?t get it.

a) You add your wife to current application. Both of you are issued landing papers at the same time. You being the principal applicant has to do the landing with her or before her.

3-4 months is on the lower side. If she has some medical condition or has lived in several countries then it could take much longer.

b) Your wife can apply for TRP. Check www.cic.gc.ca for details. However, that visa will only be granted if immigration officer is convinced that you and your wife will return to Canada in case your PR application fails to go through. There are other reasons for rejection of TWP also but I have mentioned the most relevant (based on the information) to your case.

a)Got it.

b)Is it TRP or TWP (Temporary work permit visa)? What is TRP? If my PR application fails why should I return to Canada? I needs to leave Canada before my temporary work permit visa expires, presently I am working in canada on work permit visa. Am I correct?

b) Your wife will be applying for temporary resident visa (TRV). As far as I know, she can apply for "Open Work Permit" once she is in Canada. She still needs to prove that: you and her will leave Canada, if your PR application does not go through and your work permit is not renewed.

Just last one question.

b)To get temporary resident visa (TRV), which documents we needs to submit / prove that we will leave Canada if our PR gets fails or work permit doesn?t renew? And how much chances we do have in this case? Can we expect any positive results? Any dea.

The documents she needs to provide are the ones which will show your (you and her) ties to your home country.

I cannot comment on her chances of getting the visa. Best would be to: get married, update immigration file and after your immigration file has been updated she applies for visa.

For your peace of mind, my friend was in similar situation as yours and his wife got the visa and now both are PRs.
