Subject: ARC
  Hi, my brother had applied for an ARC in New Delhi about 1 year ago and he has never got a reply. He was deported about 10 years ago for entering Canada illegally. He paid his own air fare back to India. He paid his $400 for the ARC. People are telling us that he has to pay the Govt. $1,500 for expenses, is that so?
and what is causing the delay?

The $1,500.00 is for the cost of removal aka airline fees IF he did not pay his own flight.

Do you know what might cause the delay for his ARC? The embassy is not replying to any of his letters.

I just got a client landed with an ARC from Guyana on Tuesday.

He had been applying for PR status based on his son sponsoring him but a Lawyer from Guyana wife recommended he sell everything and apply under H&C.

He lost the H&C so the Lawyer said appeal the H&C which he did.

Then when that was lost that Lawyer sent him to another Lawyer who made him file a refugee claim four years after entering Canada, dah yeah he lost again but he paid, paid, paid.

When the second Lawyer recommended a Federal Court appeal oif the failed Refugee claim he came to me.

We used so legal situation to delay his removal for about three years then sent him home to be interviewed for a Parental Sposnorship and ARC.

That was February and at that Interview he was told he was approved to return. He arrived on Tuesday October 21st 2008


NO LOGICAL REASON FOR THE DELAY!
