Subject: New here-Please help- Roy, Sharon and others.
  Hi Everyone!

Can anyone tell me how long it will take when your lawyer request your documents (example: letters, cards, bills,original marriage certificate, original birth certificate ects)
which were requsted by immigration? The documents are with the immigration in Trinidad and our lawyer is in Canada. I´m on an appeal Process. Can anyone please tell me how long does the Alternative Dispute Resolution (ADR) process take after your lawyer receive your documents from Trinidad?

You´re confused, and you should of been informed of the process.

I can only assume your referring to the "RECORD" because you have filed a spousal appeal. Is this so?

Lets say it is. CBSA has four months to produce the record from the time the appeal is filed. The RECORD which is all the forms completed and correspondence, photos etc. and most important the Officers notes why he/she refused your sponsorship.

When the Visa Post sends up the record your Lawyer and you will get a copy and only after the record has been screened will the IAD decide whether to send you to a ADR alternate dispute resolution or full appeal.

I have a few questions.

Did you do the application yourself?

The Lawyer that is retained to do the appeal is he/she the same one that assisted you with your spousal application?

Why have your Lawyer not focused on obtaining the CAIPs so you know what the concerns of the Visa Officer are?

I´m sorry to say but your Lawyer should of taken the time to at least explain the process of what happens when and what to expect next.

Talk to your partner he should know somethings that the Visa Officer said was unusual or lacking in your application. Those areas of concern are the most important to rectify at this time.

Hi Roy,
First of all thanks for replying me.
Yes I´m so confused and Yes I´m on a spousal appeal.
Immigration already send me and my husband the refusal
letters.
Answers to your questions.

1.Yes sir I did the application myself.
2.When Immigration send us the letter for us to appeal thats when my husband took the lawyer to do the appeal.
I dont understand what the CAIPs means. Can you please explain that.
I had an interview. I answer all my questions correctly.On the day of my interview the officer took my passport. But i guess some other offices had to make another decesion. Thats when thy think my marriage was not genuine.
The reason why they think so is because after my husband came the first time we got married after five days. We had a wedding ceremony after five days not a legal marriage.So i dont know why they make that a reason. We had a legal marriage on his second trip that was after ten months.
Please anyone else with a problem like this please advice me.

P.S. I know my husband five months before our wedding ceremony. I show the officer my husband second letter that he send to me on email.

You must be Chinese because this is a normal situation for alot of my appeals. Arrive say hello and get married five days later. It is a cultural difference because it is sort of an arranged marriage because another party knows both people and their families. R U from Fujian?

If you do not show a pattern of contact because you speak to each other over skype every single day or you have been using phone cards it will get you into trouble BIG TIME. Who sends snail mail anymore?

CAIP´s is the officer interview notes which will show why he/she had doubts about what was submitted. Obtainable in just a few weeks.

One more thing though is if the lawyer that Lisa is using is he/she just a regular lawyer or is she/he trained in Canadian immigration issues?

Wrong advice from the person you hired is going to make things just worse.

Canadian lawyers are not properly trained to handle complex Immigration issues and if they are trained outside of Canada is even worse!

If I would of said those true words Bill someone would of pounced all over me.

Come to think of that I heard from a client that their Lawyer had done nothing other then messing up their spousal application.

Thanks again for replying.
No I´m not Chinese. I´m From Guyana and my husband from Canada. We use to communicate on phone and MSN messenger before our marriage. But after marriage we talk on Phone most of the time and sometimes MSN messenger. We provide a lot of phone bills, letters, cards, money receipts, ect . My husband visited me 3 times after the marriage. I don?t know what else they need from us. Roy can you please tell me in my case. Do I have a 100% chance of getting through in the appealing process?

No one has a 100% chance on anything, You need to start helping yourself by fixing the problems by finding out what the original refusal was all about.

So have you requested the CAIP notes?
