Subject: withdrawing my case to sponsor spouse
i had started a marriage case to bring my fiancee over to canada to live with me from india but now i feel i no longer want to pursue this matter and want to dismiss the case altogether. My fiancee is now ready to take her medical and after that probably be granted a visa whats the best way to end the case without my fiancee knowing i dismissed it, i need help as i am running out of time

Best is the Fax and also write a letter to the CIC where you have filed the case explaining the situation of "break-up" of the intended marriage. Also write in the letter clearly and have it delivered by FEDEX or local mail (Certified) that hereon if CIC does decide to grant the visa then you are not responsible for the burden of that person. Since for next several years you have sworn to take responsibility of the sponsored person it may have financial responsibilities on you.

There is no reason to feel bad or hear to anyone being nasty on this forum - marriage is a serious business and if she was only using you to gain residence of Canada well you should have the last laugh on the matter then. I´m sorry for the situation.

Admittedly the way you want to go about this strikes me as a bit underhanded and wrong. If you are going to be withdrawing your sponsorship, you should tell your fiancee because she will find out - be it from you or from Citizenship and Immigration Canada, especially when her application is rejected or returned to her.

Since I don´t know the full details of the situation, I am not going to make a call as to whether or not you actually withdrawing sponsorship is right or wrong. If she entered the marriage simply to get permanent residence in Canada (and you did not know that these were her intentions), and/or there are extremely serious relationship problems that have since arisen after her arrival to Canada (i.e. - infidelity or a divorce in which you are parting on extremely bad terms)- you have very just reasons for wanting to withdraw your sponsorship of her.

However if you are withdrawing sponsorship solely because you don´t want to be financially responsible for her...your reasons for withdrawing sponsorship are questionable as this should have been considered before the two of you began the immigration process.

Since, I´m assuming, you are in Canada - you should probably contact CIC to find out what you need to do to withdraw sponsorship. I know that they will not refund the immigration fees (except for Right of Permanent Residence if it was paid upfront) since they have already begun processing the application. As for doing it without her knowledge, as I said earlier I don´t believe that this is possible as she will find out about it once CIC informs her that her application has been rejected (and possibly sooner then that). I believe the CIC will send a letter stating that the reason for the application´s rejection came at your request, or something along those lines.
