  Hi
We are the owner of a company. We have a employeee on work permit. Right now our company is not doing good financially to afford tp pay this employee. We are not able to pay Tax for this employee.
But this employee is paying personally his tax to able to apply for his immigration.
What can we do in this position. As this employee being our friend we gave him partnership with good faith in our company and he has access to all our account which he is misusing to get his immigration done.
He is depositing his personal money into business account & paying to Revenue canada towards his tax through which he is palnning to get his immigration.
We have tried personally to stop him to do this. But he is still doing this. What step legally we can take to stop this immigration. As he is on work permit.
Please advise.

you gave him legal partnership? if not - change the bank account so he cannot access it.

You are not CIC OR CBSA to stop This immigration , its t your buisness, you can actually stop the relation between the company and the employee, once this relation finish
its done you are free he is free

What if I complain to CIC about his intention of Immigration is to get the benefit of unemployment & other govt support.
The business is under loss. Can CIC give immigration when he doesnot have any income coming from this business.
If we dissolve the partner ship does he still have right to live in canada.Because he is on work permit or he has paid so far tax for 8 months will govt allow him to still stay here in canada.
We are looking at all the option we have to solve this issue without making big.

he gave you money through partnership for your buisness ,you spent all the money
and he is asking back for it
you want to set up lies against him to get him out of the country and
you guys both lied by paying tax for him while he is unemployed

you don t sound to be a gang of honest peoples

Thanxs for the reply.
But there is no investment on his part. we are long time friends. But when it come to financial matter we see the real part of it.
He made us to believe that once he comes to canada he will contribute which he has fail. On the basis of his mutual promise we gave him partnership in belief that he will contribute to bring the company up.
But as soon as he landed his intention is to just get the Immigration & have the previlege of coming & going whenever he wants & failed to work towards the development of company & have started taking loans on the name of company. Putting us reliable for all his loans.
And also takes companies cash money without accounting to pay towards his personal bills.
Pls advise. We are not gang we want to sought out this problem withour any problem. We were gang than cheating people know how to cheat they don´t take others advise.

OK now you are giving more details, when you said partnership
i thaugh he puted money on the buisness.

for the loans cheating you have to see with the court.
for immigration you have to break the relation between the company and him and fire him.

and then when he will apply for immigration they will ask him a lot of question about this story.

if you choose to call the immigration and tell them everything ,you have to be able to stend with what you are saying by providing evidence.

what i mean its you have to be sure that you are right 100 pr cent
immigration status is peoples life , so cic take it seriously

Hold it.

There are few different issues here.

1- If he wants to apply for a PR status, with only 8 months of employment, likely he will have to apply outside of Canada. Can he do it, maybe yes.

2- You said:

Can you prove it?
NO!!!

Not an option.....

3- Giving someone access to you bank account doesn´t make him your partner. Who owns the shares? What kind of shares are those? And how may does he own?

For what you said, he already sucked all the money out of your bank account, which I don´t think is a whole lot since you can´t even affort only ONE employee, so don´t worry. Just close your bank account.

Are All these promises (his) in writing?

If it is NOT written IT DIDN´T HAPPEN!

Best case scenario, you will terminate his employment and he finds a job else where and he will stay in the country but out of your life.

Worse case scenario, you are going to have to pay a HUGE penalty to Revenue Canada for not closing you business properly and there are going to be a lot of undeclare taxes that you are going to have to pay back, specially if you are the president of your organization.
You see, either case, he may be able to stay in the country, after all you brought him up here, you hired him and don´t forget, you made him you partner as well.


You set your self for this one.
Wait for the tax man, he will be knockin´ your door very soon.

Now We have some option to choose. We are not against his immigration.Only thing what bothered us was he would have waited for some time to apply instead of just focusing how he can get immigration. And no efforts to develop the company & being partner its issues like bills or loans to be paid.
As we are in the business where we are famous in our community. He is just focusing building relation in public which will help him in his immigration.
Its not a million dollar business its a small family business.
