If you have recieved a letter from CIC offering you the opportunity to update your application or withdraw and receive a refund - THINK CAREFULLY! Even if you have not got a letter, it is time to take a serious look at your application in light of the new rules.

IF you skill falls into one of the 38 NOC categories and you suspect you have more than another year to wait for your PR request - seriously consider withdrawing your application and applying under the new rules. DO NOT DO THIS BEFORE YOU CAREFULLY RESEARCH ALL THE OPTIONS TO YOU and you are 100% sure your skill qualifies.

Hi, Sharon,

Sorry for re-posting my enquiry to your message, but I was recommended by another user to forward my enquiry to you for your help. Please give me your valuable advice.

I have applied FSW on Feb. 27, 2008 and received ME request from Buffallo last week. There was also a request of my current employment letter in T4 form and payment stubs. My problem is I have left Canada to start a new job outside Canada, and the T4 form from the last employer will come out only in Feb. 2009.

In my current situation, how can do and what documents should I send to the consulate? Do you think it works or not by just sending them the payment stubs from last employer in Canada and a letter to explian my current working status outside Canada? If necessary, should I also send my current employment letter?

You may get your T4 sooner but CIC knows that the end of February is the deadline - therefore I would think that pay stubs would be sufficient.

I would also include the employment letter that you are suggesting.

The question might arise that you are not in Canada for one year from date of application like CIC requires - not sure how that will play out. They may want to transfer your application to your home embassy.

In my mind this issue is a bigger concern than a lack of T4

Sharon, thanks for your reply.

Even though they have requested me to make the medical check and to pay the RPRF, it is still possible to send my application to my home embassy? If they really do so, how it will affact my application as you expect? Will they withdraw my application at the worst case?

I don´t know what they will do - we don´t hear this scenario very often. Cross your fingers and try to not fret about it.
