i applied for pr under fsw in july 2006 from new delhi, and recently i received a letter from embassy which offered to get back full refund in 90 days,if i don´t opt the refund then they would process as usual,my occupation is not in new 38 list of occupations under new rule(but i had 69 points at the time of application), BUT my spouse´s occupation is in 38 list of occupations and she is also eligible under point test of 67, and having a work experience of same in 38 for last 3 years and ielts score of 7 bands in each,we both sent our ielts test to the embassy. now the question is that should i opt the refund option and let my spouse apply under new rule as i am sure she will be successful and it will take only 12 months OR should i stay applied with old file, how long it would take to complete the process in old cases after getting the letter of refund offer, would it take 1 year or more,i am not sure about time, but i am sure about time in new rules.(is this letter a sign of starting the process or first screening of our case) i am confused and stressed what should i do, please help me.thanks in advance. silver

(in reply to: new rules- what should i do?) Roy... I am thinking they should risk the fees and have the wife file under the new rules - leaving the old file there under his name?

(in reply to: new rules- what should i do?) If you are 100% sure she fits the new criteria - withdraw the old application. I don´t want you find yourself with no application at all. That is what I am wanting to avoid for you - so make sure you do your homework.

(in reply to: new rules- what should i do?) Silver, Your wife can apply under 38 rules without withdrawing your application.
