Subject: Positive substitutive evaluation by the IO
 

I received approval for my federal skilled worker application...Got the immigrant visa, which is now stamped on my passport and will do the landing soon.

Before I got the approval, I ordered my CAIPS notes. I received them after the visa and after everything is completed...

The immigration officer who reviewed my application wrote the following (as appears on CAIPS)

The subject scored ... (below the passing score 67) and therefore, cannot approve the application. However, it seems that the points scoring system cannot be used to evaluate this subject. The subject´s qualifications needed in Canada and based on his outstanding credentials, the subject can be an asset to Canada. I am requesting positive substitutive evaluation.

I concur
(another immigration officer..has a higher title than the reviewer)

Final approval. Letter for passport request sent.

Now,

I didn´t score enough but the CIC MIRACULOUSLY approved my application based on my qualifications. Everything is done..and I have now the visa stamped..

My question is:
What´s the impact of this substitutive evaluation in the future? Can the immigration officer at the crossing border deny my landing when he reviews the reviewer note regarding the point scoring system OR will my PR card denied on the same basis?

I am just concerned....

You are a proper immigrant once you land. No need to worry. Getting positive substitute evaluation is difficult, however, from my experience some visa officers tend to look applications with Canadian education (decent university and all) and work experience in a favorable way.

Thanks Samm. I believe that the immigration officer who reviewed my app considered my qualifications and overlooked my low score.

I am concerned that, in the futrue, this may have negative impact on landing, granting the PR card or citizenship based on failure to meet the eligibility on the point scoring system. I am confused.

You are worrying unnecessarily. Once you land you are a PR, you are not going to lose it unless you fail to meet residency requirements, had lied on immigration application or commit a serious crime.

PR card is only required to enter Canada through a commercial carrier and its not a proof of you being a PR as you can have valid PR card but may have lost PR status. It will be issued to you in about 4-6 weeks after your landing.

Citizenship requirements include a stay of 3 out of 4 years in Canada. Your PR application is irrelevant unless you lied during your immigration process and they find out or they find out you being part of Al-Qaieda and all.

you are a very lucky person. in 6 years this is the first time I have heard of someone getting a PR without 67 points.

congratulations. now... go and buy a lottery ticket.

Yes Lily..my good luck continues and I have now a potential employer to start my job once I land.

It is a miracle.

If I have to drop an advice here, it should be:

Provide all documents that support your good standing in your job/work/training/education such as: outstanding awards, strong letters of references, class rank...etc. Don´t just provide the certificate or degree...These things helps IO to have a good impression about you. Work on your app by yourself.

Hello,
Very impressive indeed. I am just curious how can you have such an outstanding application and not score 67. Obviously you are well educated, well trained and speak the language. Along with the age factor, I was able to score 70 with only those three sections.
Just for education sake, can you educate us on what you were lacking and how did you present your application ? I have already received my PR this week but other people and immigration consultants here could benefit from this.
I hope I´m not being too curious.

I am also wondering about this applicant. There is nothing to worry about the substitute evaluation. It is a discretion given to immigration officers to permit strong applicants who scored less than the pass marks on the point scoring system. But with 67 points, it is quite unusual that someone can get positive substitute evaluation and do not score 67. Could you let us know about your education, language abilities and experience. There is no difference once you land as landed immigrant. So there is nothing to worry.
