Subject: can we submit application at buffalo?
  I am here on work permit which is valid till 2011 and my wife and kids are here on visitors visa.

My wife is eligible to apply for open work permit. Can we submit our application for work permit (for wife)and study permit (for kids) at Buffalo or any of the other visa offices in the US?

I was in the same situation as yours and my spousal work permit was applied at CPC Vegreville, not at Buffalo, NY. Let me know if you need more information.

here are my quetions:

My foreign work permit application took about 75 days at Vegreville, does the spousal work permit have similar time-line or its given some priority?

How long did yours take?

If you can say, what are the chances of the spousal work permit being refused?, I work as an IT Auditor with a big 4 company?

Can I really apply for my kids (study permit) the same time?

Is it really now allowed to submit at Buffalo where it is much faster?

I´ll tell you what happened in my case. My husband had a Work Permit in a high skilled category (IT) and that made me eligible for an Open Work Permit.

When I came to Canada, I entered with a "Visitor Record" and then applied to CPC Vegreville requesting for change of status from "Visitor" to "Work Permit".

Please note that this is regarded as a "change of status" application rather than a fresh Work Permit application.

Yes, it would take approximately 2.5 months - that´s the timeline these days for such cases (sigh!).

Given below is an excerpt from the Covering Letter that I had written when applying for the Open Work Permit. This should give you the direction you need.

Dear Immigration Officer:

This letter is to support my application for a request to change my condition/ status in Canada.

As the spouse of a highly skilled temporary foreign worker in Canada, I, the undersigned, wish to apply for a Work Permit. In this regard, I have included all relevant information related to the principal foreign worker (my husband) to establish that he has a valid Work Permit and doing work which is at Skill Level ´A´ of the National Occupational Classification (NOC).

As I understand, this allows me to apply for an Open Work Permit (valid until the duration of my husband´s Work Permit, if approved) without first having obtained a HSRDC confirmed job offer.

The decision to apply for this change of condition/ status is on the basis of my postgraduate education and over 4 years of work experience in a skilled occupation in my home country.

I would like to take this opportunity to request for a change in status from a "Visitor" to a "Work Permit" holder so that I am able to apply my skills and experience in Canada for the duration that I am temporarily resident here with my husband.

o Photocopy of my husband??s current and valid ??Work Permit Document??
o Photocopy of ??Employment Agreement?? between my husband and his Canadian employer
o Last 3 months pay-stubs of my husband from his Canadian employer
o T-4 Form of my husband for his earnings in the financial year 2007

One last question:

How long did you wait before submitting your application for Open Work Permit?

I took a break from work for about 4 months, on my own accord ofcourse. And then applied for the OWP.

However, one does not need to "wait" as such.

Theoritically, a spousal work permit can be applied the very next day after the spouse enters Canada.
