Subject: Complain about canadian immigration
  Hi,

I?m French and live with my Canadian girlfriend in Canada for more than a year as common law partners (conjugal partners).
You have to know that I?m living now for more than a year in same apartment with my girlfriend, and I did quit my studies for apply for the permanent residence as "common-law partners" (we needed to be 1year least "common life" before being able to apply for Permanent Residence.

Here we go :
7 days ago, we came back from France (where we spent a nice Christmas with my family)
At the first and second immigration ?post?, nothing was different as the other times I went in Canada.
But, when we arrive at the 3rd one, which is more the immigration office (where they deliver you the stamp when you are foreigner.) we have been called to (avancer) and everything goes wrong for us.
After the usual explanation of my reason for being here and what I want to do in Canada, the immigration agent started told us that what we were doing for a year is totally wrong and that we totally misunderstood everything about immigration, and that the 3 times immigration people who let me in during the past 16month were probably lucky times and that they didn?t have a good reason let me in.
?

She continued by saying that she has no reason let me in because i apparently visited too much Canada (for her) and that?s it?s impossible for a 25years old adult doing nothing for a year (my girlfriend explained her that it?s dedicassion and that I?m doing all that for her with my parents help (for money?etc) But she just stayed in her position of thinking and saying I?m a freeloader.)...

Of course my girlfriend and I were shaking and almost crying when she asked us that we are not married and so that?s an other point for not let me in Canada...
She finally explain us a lot of wrong thing about what Canada want from us for ask a permanent residence (as for example: that it takes 18 to 24month for a permanent residence asked from Canada when its 5to6month and that what Canada want is that I had work in France when my love is in Canada and that could be just the perfect thing to do ?She said that?s what Canada want. Of course she was totally wrong...

At the end i asked her how i will get back my stuff which are in our apartment (in Canada)
And she just said as a Savior that she gives us 3month to think about all she said and that in her mind I have no chances to have any prolongation visa or residence.
And she put my name under a list of Jamaica, Poland or other country like that. With a big paper (stapled in my passport with all those ?flashy governmental stamps?)

When we arrived at our final destination in Canada we went immediately to the immigration office of our town and the guy just told us that we are doing everything perfect and that this woman was insane and really weird in her explanations.

So i searched pretty much everywhere on the web but found nothing about complain about such a ?crazy? comportment and telling us More than 30minutes wrong stuff about immigration...(her work need to know all immigration rules and possibility of immigration i thought).

Then because she gave me only 3month instead of the 6 asked, now we have to do everything in a rush and i have to ask for prolongation of my visitor visa with a work permit demand in same time of my permanent residence demand.

We felt so bad in front of this uniform woman who was so persuaded about all the wrong things she told. Every question she asked, she almost didn?t let us answer because at the first word we were totally wrong in her mind, so she answered her own question with wrong answers
I think she deserve a suspension or a year of studies about immigration. Cause she also told us that she see a lot of couple like us with the same problem of misunderstanding?.It?s quite scary for me, because she doesn?t know a thing about immigration..
.Can somebody tell us if there is any way that I can complain to any agency, about this immigration woman.
Thanks to you who read that entire story.
But it has to be a little developed, for everyone comprehension.

You were asking for entry as a visitor when you have no intention on leaving makes you NOT a visitor.

Have you even applied for a spousal sponsorship.

Look up the definition of conjugal because nothing here in this posting in anyway implies that your unable to marry.

I can´t believe that she actually let you in. She had all the grounds to refuse your entry into Canada. Your intentions as a visitor are not "to visit" you are planning on staying in Canada yet you are not a permanent resident or a Canadian citizen.

Technically you don´t have the right to enter Canada, your entry is up to the CBSA officer at the port of entry.

Then how can this "common law partner immigration" can work when I must lived for 1 year with my girlfriend before I can ask for the permanent residence...
I mean that makes no sense to me.They ask me to live with her IN Canada and then ask for the residence, but they also would like to refuse me cause I stayed too much???...

I also show her my "return Fly ticket" as I always do.(my father always pay for the return too)to proov that if something goes wrong I already have my return Flight paid 6month later.(with changing option = 100$ if I have to change the date.)

And, what about all those wrong things she told us about delays or the mariage thing that could accelerate our demand.(which is not true).


Why at the immigration office, people tell us that all we are doing is right and that every thing will be ok.And at the immigration when we entered, this woman just told us everything we are doing is wrong...

I would like to know who is wrong or right cause there are 2 different and opposite version for the same thing.
Its really hard to know what we can do now...

offering you a very very simple solution of this. Marry your girl friend and apply for in canada spousal sponsorship and you will be able to stay here.

Mike he has already lived with her for more then a year according to his posting. I asked if he had submitted a spousal application but got no response.

I really think that the CBSA Officer got it perfectly right when she said "But she just stayed in her position of thinking and saying I?m a freeloader.)"

Been in Canada for a whole year and not working even illegally. I wonder if he vacuum´s? No maybe Daddy comes over to Vacuum and do the dishes.

Roy, i´m following the instruction about Application for permanent residence in Canada ? Spouse or common-law partner.
Then we are asking the PR as common-law partners so why are you talking about Spousal application?

And yesterday I went again at the immigration office and all we are doing is all that Canada is asking from us.So everything will be send just after my medical exam.

Then we´ll see if my visa will be extend.
Cause we have to sent the permanent residence demand and the extend for an "open visa permit" , all in the same time/enveloppe.
So we will see...

PS: stop being so aggressif and try help other instead of making a judgment without knowing anything about people...

Jeremy, you are right to complain. The agent at the point of entry gave you headache for nothing. You have right to re-enter Canada and apply from within Canada. You do not need to marry to apply for PR, otherwise there will be no application as a common-law-partner. You can have a dual intent (Permanent residency application and be/or apply as a temporary resident). CIC insist also that you maintain your legal status in Canada while you are applying for PR. Wwhe you will ask for extension of you temporary resident status as a visitor, do not forget to mention that you applying for PR and submit a proof of it ( receipt of processing fees payment, for example). CIC can also give 1 year of stay instead of usual 6 months. Assure that everything is in order and that you are sending the file to the appropriate place for each. Good luck!!

Actually the agent could have turned him away simply based on his statements.

You do not have a right to enter into Canada just because you want to.

I have seen and experienced it first hand.

If they think you are not going to leave that is sufficient grounds to not allow entry.

Be glad the agent let you in.
