Subject: Husband's Deportation
  I would like to know what my husband would have to do in order to re-enter Canada again. He was deported a few days ago back to his country Germany. I am a canadian citizen living here in Canada. I want to know if there is anything I can do to help him come back to us. We are married and have a child together also. I believe he was deported for some charges that were dropped already (non-serious)and mainly because he was here on an invalid Visa.
Can someone help please. I don´t know much about this stuff.

You will need to get an ARC for him to be allowed back into Canada.

First get the facts which you (must) already know!

Your comments that he was ""deported" for charges that were dropped already is ridiculous.

Illegals do not get deported because the police or others make allegations that are unproven in a court of Law. Illegal persons come to the attention of CIC and CBSA due to criminal charges.

Let us look at it this way.
The two of you were living as husband and wife FOR (x) YEARS. One night on the way home from his work he got stopped for a broken tail light. He tells the truth that he is illegal and CBSA are called.

CBSA call him in for an interview at which time they issue a 44 report with all of their allegations on it. Your husband admits that he is not a PR or Canadian Citizen, that he is a German Citizen and that his date of birth is --/--/---- He then admits he entered Canada as a visitor on __/__/2002 and has not applied for and received an extension of that status since 2002. Your husband does not make a refugee claim against Germany so the CBSA officer issues an (EXCLUSION ORDER).

A while later he is offered a Pre Removal Risk Assessment which of course he refuses being from Germany.

Your husband is told to bring in his own ticket or have CBSA pay for his removal.

When he gets on the plane he is issued with a (confirmation of departure) form.

The only other scenario is that the CBSA officer approached the crown to withdraw or stay the charges against your husband to affect his removal. That scenario creates a major problem because any charges stayed can be re-instated within the year and currently make him inadmissible.

Since it is PROBABLY an Exclusion order he needs to stay out of the country for one year or seek the permission (authorization to return) ARC to return Then you need to apply for an ARC and tell why he did what he did and say sorry.

It is not simple.

being here on a invalid visa is singularly enough to be deported. he has now shown contempt for Canadian immigration law and it appears he also had a run in with the law that triggered the contemplation of charges. You have also showed contempt by not sponsoring him.

So...I would suggest you read Roy´s post again. he told you what has to happen. Basically, you need to beg for forgiveness and then sponsor him from outside the country. I would not do it without the assistance of a well qualified immigration consultant or a lawyer with extensive immigration experience.

there is diffrant kind of deporations for diferant reasons
each one resuting on diferant kind of ban.
get a copy of what cbsa gave him like departue certificat..ets

and get consultation and try to get maximum answers and then dicide what to do.

I found out everything already so I know what to do. I was at the immigration office yesterday and spoke with an officer about my situation. That´s what I should have done in the first place. Anyways I am at ease and I know my husband will be home soon.

lucky that you had a chance to talk to an immigration officer.
so probably you will start a spouse sponsoringship,berlin embassy has a verry short processing time.

Yes that is exactly what they told me to do. Once I approve to sponsor him then he will go through Berlin and hopefully come home as a permanent resident. I just hope this process doesn´t take forever. I wonder how long they will take to approve me here for sponsorship and then his process...I don´t know how long this will all take...
