Subject: Visitors Visa with Arrest |

Hi All,
I am planning on getting canadian visitors visa from US.
I was arrested (fingerprinted and photographed) for speeding and was charged with negligent operation about 4 months ago(I was driving at 102 in a 65 speed limit on a highway). I paid the fine for speeding and I got the negligent operation charge dismissed by pre trial diversion. by taking an evaluation class. never met the judge or the PP.
Here is my Question
1, If I mention it, what are the chances of getting my visitors visa. Is there a chance that my application will be denied due to criminal in admmisibility?
2, If I dont disclose it does the canadian Consulate or the immigration authorities will be able to find out about this arrest.
Any help regarding this matter is greatly appriciated.

(in reply to: Visitors Visa with Arrest) Arrest for speeding? One usually gets speed ticket!....Here you have to check the terminology..
if the question on application is about felonies, charges, convictions, the question is whether your arrest should be included under these terms? if the question is whether you have been ever arrested, your answer should be yes with explanation and supporting documents.

R U American? If so why would you need to apply for a CVV?
If your not a US citizen apply for a (TRP) Temporary Resident Permit to overcome your inadmissibility. You will have to have a valid reason to enter Canada and clearly explain why your coming and the need plus duration etc. etc.

I am not an American, so thats why I have to apply for the visitors visa. At this point I am planning to stay in canada only for a week.
The arrest was because I was driving +30 over the speed limit and the cop said that I changed lanes with out turning my indicators on and charged me with negligent operation of a motor vehicle, which is a misdemeanor.
My fear is, wether my visitors visa application will be denied based on this arrest, even though I got the charges dismissed. and I also want to know if dismissal thru pre trial diversion is considered as a conviction for canadian immigration?

(in reply to: Visitors Visa with Arrest) Go right on ahead and apply. If they object, it will be known then. On your part, treat that a fickle incident and disregard. It is unlikely it is even on your State Records (you can check this by obtaining a police report from the Sate where you were stopped).

My fear of my visitors visa getting rejected is due to the fact that reckless driving is an indictable offence in Canada and my charge is negligent operation which is similar to reckless driving.

Thanks for your valuable inputs, I got my TRP today, I disclosed my arrest in the application and attached a certified copy of the courts final dispostion saying that the case was dismissed.
No question was asked and got my TRP in couple of hours.

(in reply to: Visitors Visa with Arrest) hi i was arrested for false aquisation of sexual assault and the case was dropped the same day i was areested by the police and no further action was taken aginst me so does this reject me from getting usa visa coz my fiance is planning to send me a fiancee visa
