Subject: Where is this situation going?
  First, I am a Canadian citizen, born in Canada. My husband in from the USA. Here is a short timeline:
- He comes to Canada on a work permit in 1999.
- We get married in 2000, 2 or 3 months before the work permit expires.
- The work permit isn´t renewed.
- 2002ish he applies for permanent residency and the papers are lost. {everything, birth certificates, photos, etc}
- Mid 2006 he re-applies and the paperwork has been "processing" ever since.

For 2006 and 2007 he worked and paid income tax using his old work permit number.

The processing center is saying that they have no record of his application being processed further. They say that requested an additional $75 for an additional form and it was never paid or submitted {we did, most definitely}.

Our MP is trying to find out what exactly is going. We´ve been getting the run-arounds for months.

I´m worried about what could happen... could he be asked to leave the country? Fined? Etc?

between the first paper lost(2002) and the seconde submission 2006,did he stay illegaly in the country?
-he worked with an expire work permit?

the solution is sending sponsoringship application +application to restore his temporary visa status and wait for the interview in your immigration local center with a couple of questions.
the immigration officer will sure focus on the period 2002-2006,prepare your answers

I´m not sure if he was illegal or not? We´ve been married since 2000. Does he have to have any other type of status besides that?

Yes, he worked with an expired work permit.

Would applying for a work permit now while his PR application is being processed be a good idea?

There is no immigration officer in our area, we are rural.

dear
being married is not anough to have status in Canada,
its verry recomended to apply for the work permit.
working with an expiring work permit can bring you a lot of trouble.
the workpermit application will be aprouved only after the first stage of aprouval of your sponsoringship.
i know you may living a hard time with this situation...the solution will come sooner or later,

Mm what are you talking about????

Get your facts straight and ask more questions before you respond.

First prior to the current act coming into effect on June 28th 2002 you could sponsor a person In-Land who was out of status or not did not matter. There was also an illegal De Facto clause with H&C. WHO CARES WHETHER HE WAS OUT OF STATUS OR NOT.

Good news for Spouses public policy happened on February 18 2005!!!!

Now was the application in 2002 and 2006 submitted as an overseas or inland application?

THERE IS NO PROBLEM WORKING WITHOUT AUTHORIZATION BECAUSE IT DOES NOT MAKE YOU INADMISSIBLE!

Mm come on. They are husband and wife since 2000 and you want him to be on a work permit!!!!!!!!!!!!!!!!

Your rural and your husband status does not allow you to speak to the call centre agent or attend at any near by CIC office for eight plus years.

KEEP DOING YOUR APPLICATION YOURSELF OR TAKING Mm ADVICE!

there s nothing i said ,that is in oposite of what you said , exepte for the fact :

yes there is the 2002 act ,that she has to send her application for an inland and then CIC will probably restore his temporary resident status.
any way just forget about it

Why would Immigration restore an out of status person that came to Canada on a one year work permit in 1999????

That would mean as long as your out of status if you say SORRY even eight years later they are going to re-instate your work permit!!!!!!!!!!!

You got ninety days to get back in status. Period!

Any Immigration Officer would prefer to see someone working without authorization then sitting on welfare and using a single mother or Canadian for their Income. When any illegal is helping to pay the bills it clearly shows a commitment between the couple.

The Lord Helps Those Who Help Themselves and in EIGHT YEARS they can not walk into an Immigration Centre somewhere in Canada because they live in the country.

Mm there are those that one can assist with sound advice but not this poster. Leave it!

Your information has been very helpful.
It would have been an inland application I believe. Sent to Vegreville, AB from Manitoba.

I´ve had a conversation with an immigration lawyer who lives in the city (6 hours from us) and he is confused by our situation because of the bizarre runaround/mixed messages we are getting from the processing center (the one in Vegreville). We´ve had our MP´s office working on it for almost a year, and then the MP died suddenly and a new person was elected.

So right now, he is getting all his stuff ready to re-apply (for the 4th time)& send them their fee (for the 4th time) if that is what the situation calls for.

The MP´s office is waiting for a callback. And our MP is in Ottawa sitting in the house at the moment.
