Subject: Don't Make A Mistake/Lie Spousal
  To All

Question 17 on the Sponsors questionnaire IMM 5540 asks the following question.

Quote "Have you ever been married or in a common law relationship or conjugal partnership before"? Un-Quote

If your sponsor states NO for what ever reason and the answer should of been YES*********

YOU THE SPONSOR COULD LOSE YOUR PR STATUS OR WORSE YOUR CITIZENSHIP.

IRPA 16(1)
16. (1) A person who makes an application must answer truthfully all questions put to them for the purpose of the examination and must produce a visa and all relevant evidence and documents that the officer reasonably requires.

In the past it was more normal to write a report under.

IRPA section 40 (1) (a) for misrepresentation.

Here is the way the Visa Posts are approaching a simple but serious mistake IN THE FORMS. The Visa posts excludes the applicant for two years under 16 (1) and also writes a 40 (1) (a) allegation for misrepresentation which can be appealed to the IAD.

THE VISA POST DOES THIS TO GET YOU TO APPEAL THE SPOUSAL SPONSORSHIP!!!!

Now that allegation 40 (1) (A) can easily be appealed without SERIOUS ramifications to the sponsor (CC-PR) and the issue is whether or not the misrepresentation is material to the application or not. All questions being relevant. When Dad applies for PR status because you sponsored him and he misrepresents he passed high school when in fact he did not that is not material to a Parental sponsorship so no error could be induced.

Here is how CIC makes it happens. IF you were Landed based on a common law or conjugal relationship they no the answer should be YES!

Lets say you do your spousal application yourself and rush through your Spousal Sponsorship forms because you are in and answer NO!

OR**

Let us say a family friend asked you the sponsor if this is your first marriage and you said yes because it is and they answer question 17 NO when the answer should be YES!

Let us say that an authorized or unauthorized representative or their staff did not read all of question 17 in its entirety and you said NO, quickly! They put down NO when the answer should be YES!

ANY ONE WOULD THINK IT IS NOT MY FAULT AND QUESTION 17 SHOULD BE THREE SEPARATE AND DIFFERENT QUESTIONS. But it is not, three questions!!!!

You will not be under the same roof with your poartner nightly for at least two years, WHAT, panic sets in and an authorized representative says give me the money, honey, LET´S APPEAL!!!!!!

HOW CAN I LIVE WITHOUT MY LOVED ONE FOR TWO YEARS - APPEAL!!!!!!

IF YOU APPEAL Any IRPA 16 (1) REFUSAL CIC CAN TAKE AWAY THE SPONSORS PR OR CANADIAN CITIZENSHIP STATUS.

Some times it does not pay to NOT PAY for a quality Representative.
Sometimes you can do it yourself!

WHAT EVER YOU DO MAKE SURE YOU GO EVERY SINGLE FORM AND EVERY SINGLE QUESTION BEFORE ANYTHING IS SUBMITTED.

This particular client retained an authorized representative who had their staff complete the forms. They never reviewed the questions with the sponsor before telling the sponsor to sign here. The person (REPRESENTATIVE) is still in business but no longer authorized and they admitted to the error. CIC could care less!

WHAT GETS ME IS THAT PERSON IS (VERY BUSY MAKING LOTS OF MONEY) SO NOW I WAIT FOR THE NEXT DISASTER CLIENT TO WALK IN.

Always drink the best wine, eat at the better restaurants, hire a professional carpenter and when it comes to Immigration-----------

GET LOTS OF REFERENCES.

Now I sound like Mike Holmes. LOL

Long time no see.


Ok, so If "I" as an american am sponsored by my canadian wife, being this is her and my first marriage never have been in a common law relationship and she says "NO" to question 17.

I land and become a PR. How will CIC find out that she lied?
Do the still investigating the applications once approved?
Do they re-open the sponsor´s file once the PR applies for citizenship?
This is not my situation, but I am dead curious.

Look at it this way she sponsored you and regardless of being a citizen she was assigned a client ID number.

Your relationship ends.

Four years later she sponsors a new partner and answers question 17 as NO when in fact she had been married to youn before. GOT YA!

This client got attached to her common law partner FSW so he would get sufficient points. Got landed as a dependent of the FSW Principal Applicant then the common law relationship ended. Three years later submits a Spousal Sponsorship and answers NO to question 17 because she was asked,

IS THIS YOUR FIRST MARRIAGE??????.....YES!!!!

Right answer, wrong question.
