Subject: Applying for Pr for my wife
  Now, me and my girlfreind are very young and we have decided to get married. The thing is she is illegal and I am a permanent resident. I called the call center, and ask them if I can apply for my wife is she is illegal in canada, and can she stay in canada, while the application is processed. They said no.

However I found this on the website, which I find is very contradictar. It puzzles me and gives me a very big headache, because neither me nor my to be wife wants her to go back home to get this permanent resident thing done.

It is your responsibility to ensure that your temporary resident status remains valid until you receive
permanent resident status. When you leave Canada, you relinquish your temporary resident status and may
not be able to return to Canada.
Maintaining Legal Status in Canada
You have two options available to ensure that your legal temporary status in Canada remains valid until
permanent residence is confirmed:
1. You can apply for both an extension of your temporary resident status and permanent resident
status at the same time. If you choose this option, complete both an application to extend your
status and an application for permanent residence. Be sure to include both applications and all the
supporting documents and fees that are required in the same envelope.
Note: The acceptance of your application for temporary resident status does not guarantee the
acceptance of your application for permanent residence.
2. You can apply to extend your temporary resident status separately from the application for
permanent residence, but you must do so before your temporary status expires. You have legal
status for the period of time indicated on your visitor document (work permit, study permit, visitor
record) or temporary resident permit.
Note: On February 18, 2005, the Minister announced a new public policy under which legal
immigration status is no longer a requirement for spouses and common-law partners of
Canadian citizens and permanent residents in Canada who wish to apply permanent
resident status provided that they have an eligible sponsor. However, all other eligibility
requirements continue to apply.
Although out-of-status spouses and common-law partners may now apply for permanent
residence in the Spouse or Common-law Partner Class, persons without legal immigration
status in Canada are unable to work or study and may be subject to removal proceedings at
any time for failing to have or maintain legal immigration status in Canada.

I´m sorry about the long read, but I am scared about this thing because it seems to me that some of these immigration officers are not well informed and these statements make a huge contradiction which might result in wasted, time, money, broken dreams etc. I love my woman, and right now, I don´t want to be away from her, and neither does she. Can someone truly tell me if its Ok if my illegal wife can be sponsered inside canada and be granted permanent residence without being kicked out? or shall I just apply from back whense she came from?

If your wife came into Canada with her own visa and it expired then she can file without having to get out of the country because she did not come in illegally she did not break any laws coming in, she just stayed after the visa expired.
If she came in illegally with a fake visa then she did break the law and must leave the country to apply, which will be bad because the process could take up to two years to be completed.

I imagine there may be other factors to take into consideration and you really dont give a lot of information.

My advice is to talk to a consultant/lawyer about your situation. Couple here roy and sharon I would listen to, others I wouldnt ;)

I will be coming to canada in few days and I´m planning to over stay after my visa expiry and work. later i can apply for PR and stay in canada or i ll be kicked out?

Need assistance on this ASAP.

This is what i did....... i made a post on the now closed immigration.ca now immigration.ca/forum.

i got some good advice. I applied outland at the port of spain office for my country and got through in 3 months. I placed in everything including a police report, bank statements, pictures, wedding pictures etc. I didnt hide the fact that she was illegal but wrote that i sought legal advice and they told me to try this particular means.

My wife forced me to go to a legal aid...(we got married) and the legal aid told me that she should return home and gave me a letter that stated that she should do outland. i put that letter in the application but she didnt return home. Instead in a letter which i wrote i stated that me and my wife lived together until a certain date. e.g oct 18th, i sent it in oct 21st. i didnt tell them that she returned home.

in about a month i was told to pay the fee. in about 5 days i sent an email and was told to send her passport. she got her passport back in the next month which would be feburary 2010.. i sent the application on oct 21st. we went to the NIAGRA BORDER and she went to the U,S side, she was rejected and came back to CANADA. Now she is landed.
