A PR can lose his status if it is found out that the s/he misrepresented on the application or if convicted of a serious crime.

NO, after you are granted you cant be deported for mis representing your application, after granting PR no one is going to bother what you provided them with.

The only time a PR can be deportted is: Read below

There are several ways you could lose your permanent resident status:

* A permanent resident who does not meet their residency obligations could lose permanent resident status.
* If convicted of a serious crime, a permanent resident may be deported from Canada.

You must meet the residency obligations in order to keep your PR status in Canada.

NO, after you are granted you cant be deported for mis representing your application, "after granting PR no one is going to bother what you provided them with"

No one is going to bother you once you get your PR is not a correct statement. For example, if you did not declare that you were married on your application and landed as a single person then you are barred from sponsoring your spouse forever and removal proceedings may be started against you which means they can take away your PR if they decide to.

People even lose their citizenship (naturalised) in some cases due to serious misrepresentation issues.

How long will they notify you:

if you have sponsored a (non declared) spouse from the time of documents were submitted?

if removal is on its way from the day they found out you misrepresented under IRPA 117?

just curious. pls share some stories...

The letter stating that you cannot sponsor your previously undeclared spouse should take only few weeks after the submission of the application. I think at the same time your case is also referred to the authorities who will determine whetther to come after you. If they do decide then you can delay the whole process by going to the court and all. However, I do not think it will be of much help.

A lawyer may be able to provide you with exact procedure.

People who did not declare their spouse during their PR application usually try to go for divorce and then remarry to get a new marriage certificate. This can work as long as noone finds out though you will always be having sleepless nights.

The venom comes out and I was not part of it ahhhhhhh I missed this stuff.

There has been a whole bunch of postings lately regarding (MISREPRESENTATION) IRPA section 40 subsection (1) paragraphs a), b), & c). Then as well section IRPA 16 which basically states everyone must tell the truth.

This posting is about a Permanent Resident having their status removed.

Just because one has LIED or been convicted of a (serious crime****) does not mean they will be deported.

Serious crime JOKE!

Any assault, any theft etc. etc. can easily be explained away during the appeal process. In fact many Permanent Residents who appeal & have a serious crime issue receive a stay of removal with certain conditions prior to any appeal hearing.

Young male goes to a nightclub and gets into a fight, serious crime. Young male gets told to plead guilty by Legal Counsel (Lawyer) and you will get anger management and probation. Lawyer says nothing will happen!

Then comes the letter from CIC/CBSA.

Young Lady goes shopping and her friend puts something in her purse and again the Lawyer suggests plead guilty it is your first offense nothing will happen the Judge may go more severe if you fight the allegation, I have worked a deal out with the crown.

Then comes the letter from CIC/CBSA.

Teenage Girl is included in her Mothers sponsorship and she is living in her country while Mother is in Canada. Mother is legal and is sponsoring her dependent daughter. Seventeen year old gives birth to child and when she turns eighteen is asked to complete her own application forms and does not list the daughter as her child. Then when eighteen after submitting her forms just before coming to Canada she gets married to the babies father thinking that when she tells her Mother that she is a Grand Mother it will makes things better if she is married. Applicant does not inform CIC prior to Landing that she is now married.

5 Years later sponsors husband and child and the dreaded letter comes.

All three were ordered deported by the Immigration Division because of the Black and White nature of the Law.

All three appealed to the Immigration Appeal Division and and all where not deported based partly on circumstances and H&C reasons.

No PR should LIE, NO ONE should commit a crime but there are rare situations and mistakes we all make and lots of time a quality representative can overturn any deportation order at appeal.

Do your research and never retain someone unless you know they are experienced in your area of concerned and they provide references.

Do not be the first to throw a stone until all circumstances are known. WE ALL MAKE ERRORS!

Hello,I just need some advice.I´m sorry that my english is very limited,here´s the story of my friend.She was sponsored by her Mom by the age 16 the she turned 17 she made her medical exam,due of delay of the fonds,the medical exam expires then the next year when she was 18 another medical exam was requested but she was 3 months pregnant during the second medical exam,she wasn´t aware about the misrepresentation of the child,after 8 months she deliver the baby,She thought that she should do the same application as before she gets pregnant,all the application was signed by her oldest sister which is the accompanying of the minor.....I hope you guys understand my story.....

Can a person be deported if they tricked a friend into marrying their brother and then hid the divorce from them and then pretended to be them and forged their signature in front of a lawyer who never asked for identification...if he/she has their permanent resident card?
