Subject: Please Help - Landed Immigrant
  Dear Sir or Madam,

I have lived in UK for 7 years. I got Canada Immigration Visa in Jan 2006. I then came Canada in May 2006 and became PR. Unfortunately I had to leave after 10 days as I was working full time in UK and cannot leave Job with incomplete projects. I managed to finish all the projects by January 2009 and immediately came Canada permanently in the beginning of Feb 2009. Now Please help me with the questions below

1) Do I need to file tax return this year in April? Though I was not resided in Canada in 2008 but I am landed immigrant since May 2006.

2)Do I need to pay any tax on my savings till January 2009 or the money I have earned between May 2006 and January 2009? Please note that I have Paid full UK taxes.

3) My employer is asking to do some sales in Canada for him. I have read that you need to declare world income. If in 2009 I work for my UK employer and get paid in UK. Will I be paying tax again on the Net Income in Canada even after paying Tax in the UK.

Your urgent help will be highly appreciated.

Kind Regards
Amer

1) Canadian citizens or PRs only need to file tax returns if they owe taxes. You can be a landed PR and never have to file a return, if no taxes are due. First, it sounds to me that although you were a Canadian PR in 2008, you did not have residential ties to Canada and had no Canadian income where you owed taxes. On that basis, you don´t have to file a Canadian tax return.

2) You say you established residential ties to Canada in Feb., 2009. Again, if your income in 2008 was from the UK and not Canada, and you had no residential ties to Canada in 2008, then no 2008 tax filing is required. This is regardless of the fact that you´ve been a PR since 2006.

3) For the 2009 tax year, if you live in Canada, you´ll be considered a resident for tax purposes. Therefore all world income must be reported, including that from the UK. But since Canada has a tax treaty with the UK, you won´t pay tax twice on that same income. When you file your 2009 Canadian tax returns, you´ll be guided on how to file properly to avoid this. You may want to look at more on this from Canada Revenue, here:

Record of Landing Form (in reply to: Please Help - Landed Immigrant)
The website I have been given for finding a IMM1000-Record of Landing Form is www.cic.gc.ca/english/information/applications/certcopy.asp. When I enter the site there is no IMM1000 on the list so where can I find this asap? Is there an office in Surrey,B.C. where I can pick one up?
Thanks for any help you can give,
Dolores.
