Subject: Challenging question to all the Experts in the for
  I became a permanent resident of Canada in Oct 2006 (landed). I went back to USA the same day I landed after getting my PR card and SIN card. Never resided in Canada for one day.

PR Card expires ?? Oct 2011
Residency Obligation Deadline ?? Oct 2009

I have resided in the USA ever since the day I landed and have been in the USA for last 10 years. I have applied for US GC and it is getting delayed beyond reason.

I got married in 2007 and never added my wife on the Canadian PR thinking I will get my US GC by the time my residency obligation deadline is met. But that has not been the case and I regret it.

I intend to re-file for my Canadian GC all again with my wife this time.

Q1). How do I relinquish my PR status voluntarily outside Canada as I am resident in US? I did email buffalo and they said send your PR card with a letter that you are relinquishing to the Query Response Center in Canada. But I asked them again that I am not a resident in Canada but outside in USA and they did not reply back.

Q2). How do I voluntarily reqlinquish it from USA even though my PR is still valid?

Q3). Since my residency obligation deadline fails from Oct 2009 can I reapply from that time? Or can I not do anything until my PR card expires which is Oct 2011?

Q4). Will there be a problem if I re-apply again since I had voluntarily relinquished it the first time. Is not adding wife a good reason for re-filing?

Since you obtained your PR before getting married, you are fine. If you can fulfil your residency obligations, you can apply to sponsor your wife after you have permanently moved to Canada.

The rules for getting permanent residence in Canada have changed, so better check whether you still qualify or not before you relinquish your PR.

I positively want to relinquish because I will not be able to meet the residency obligation starting Oct 2009 and I cant move to Canada frmo USA by Oct 2009. So I have to relinquish it. But my question is can I relinquish it voluntarily even though technically I can right now still go and live there and maintain 2 years to fulfill residency obligation.

You don´t have to relinquish PR. You can just let it expire by doing nothing and staying outside of Canada. It may reflect better to formally relinquish and explain why, if you intend to reapply in the future.

The skilled worker rules have changed with a much smaller number of skills (38) in order to qualify. It also appears the annual quota will be reduced, making skilled worker immigration even more difficult

I believe you could reapply after Oct 2009, since your PR status would have expired by then (if you never return to Canada), even though your PR card shows validity to Oct, 2011.

From my experience, if you re-apply after not following through on a previously granted PR, they will want to know why. There´s actually a section in the application that asks if you´ve ever applied for PR status in the past, and to explain the circumstances. It all depends on your reasons in how they go forward with a re-application. If the situation is justifiable and reasonable, there´s probably no affect on a new application, and it´ll be processed under the new rules and quota. If it sounds capricious, they may elect not to process again.

If you value your PR status, I would not go through this again and take the risk. As Samm suggested, work out a way to move there before October and sponsor your spouse. There´s very little risk this way.

Thanks a lot for your detailed response. It is very helpful. My question to you is:

1) Can I voluntarily give it up before Oct 2009? If so, will there be any consequences for my re-filing?

2) Is is not possible to relinquish it until after Oct 2009? Is that what you mean?

3) Say I dont voluntarily relinquish it. And I still keep my old PR. What would happen if I re-file again second time this time with my wife? Will they reject the application? Or will they accept it and demand me ot send my old one back?

P.R Renewal and waiting of 150 days..worst work process (in reply to: Challenging question to all the Experts in the for)
Dear I landed in Canada in 2006 DEC as permanent residence after waiting since 1999 my applications.after getting news papers for jobs i got across a company who was asking somebody from my home state Punjab to help ,the end company being a Canadian company called me for interview and handed over me the appointment letter as property manager in India.I filled my Tax returns T1 from the period of 2007-2009 and also my employer filled my tax returns from periods of 2007-2008 as T4 which not only enabled me to remain with Canadian company payrolls for two years means 730 days.plus I stayed in Canada two months each in 2007 and 2009 ,now problems is that end company went into litigation with state govt and i have got a another Canadian company having direct offices in London.My problems is that i cannot afford to wait for 150 days for renewal of my PR cards effecting my training upto such long time due my joining in London on jan 1st...Anybody can suggest that inspite of air ticket and urgency shown what is the best way to get PR renewal asap
