Subject: landed immigrant / permanent residence for wife
  I am a canadian citizen who has just moved back to canada because I found work here in the toronto area. My wife and 4 kids are still in the states until the end of the school year. I know my kids will have no problems immigration wise but what about my wife? Is she granted landed immigrant status because of the fact that me and the kids are crossing to live here? How does it work? I am in the process now of filling out the application for permanent residence and my sponsorship application for her. If that is "in process" how does she enter the country?

If your wife does not have her PR when she is coming to Canada, it can be tricky for her to come in. It is basically at the discretion of the Immigration Officer at the Point of Entry. She is only able to come in as a visitor, and if the IO suspects that she is going to be moving, they are within their rights to deny her entry.

That said, they could give her a visitor record where she is able to stay in Canada, however she is a visitor and can not work or study. If she comes in and is able to show that she is married to a Canadian and the PR application is in progress, they may grant her entry, however there is nothing that says that they MUST allow her into the country. Recommendation is to file and get well onto the path so by the time she is ready to go, they can see that the application is in progress and you are waiting out the last few months.

You may also want to hold off breaking all ties to the US. This may help her case as they will be able to see that if for some reason she is denied, she is able to return to the US.
