Subject: PR Card Renewal Obligations - Experts Pls. Help
  I am currently in Canada and short of 3 months of completing the Residency Requirements of Permanent Resident due to late arrival in Canada and PR Card is about to expire end of this month.

I am told that if I do not apply immediately for PR card renewal but do so after 3 months, the 5 year period will be counted from the date of receipt of application enabling me to complete my residency requirements of 2 years in a 5 year period.

Will that be correct?

Don´t think that it makes any difference but want to mention that during last 21 months - I have traveled to US about 5 times for two days each, on a business visa - so I´m thinking that´s another 10 days loss in my residency day calculation.

You have been adviced wrong.

You have to meet the residency obligations on any given day as a PR. If you have not met residency obligations in the past but do now, it does not matter as you lost the PR status the day you failed to meet the residency requirements. So, according to what you have told you are already not a PR.

PR card expiry date is irrelevant to residency requirements as it is issued for 5 year period. You can have a valid PR card but no PR status like in your case.

If you were in US as part of your job with a Canadian employer then you can count those days.

Samm is 100% correct.

PR card validity dosn´t necessarily mean valid PR status.

The 5 years clock starts at the day of landing. So, it doesn´t matter whether wait for 3 months more to fill the missing date.

You may show some valid/legitimate reasons for the absense like family problem....student in other countries....sick...of cours with valid supporting documents.

Regarding PR card residency days for 2 years out of 5 years,Do they check status every year or so , or only at renewal time they do, I was out of canda for 3 and half year, i am planning to step in canada now and stay for rest 1 and half year as i have valid pr card, will that work? or they stop me at port of entry.

I am canadian living abroad with my wife holding PR Card expired since 2011. She couldn´t go to canada due to her serious illness. she was always living with me. is she still considered a permenent resident? can she ask for a PRTD
