  Hi,

I know I guess I´m being ignored, but I wanted to try again...

I need to clear something up and would appreciate your guys? help. I?m having a hard time finding any precise information about this and I sort of need to prove to somebody I?m right. I mean, she is a good friend and I want what?s best for her and if this works I don?t care. I just wouldn?t want anything to happen to her that she would regret.. It?s got to do with misrepresentation and before you get all angry please consider that even though it is wrong, after all it is fraud, people aren?t perfect. No one is, and when it comes to trying to make a better live for oneself some people will step outside of their code of ethics if somehow, at that moment they can justify to themselves the risk involved...

She applied for a PR through Skilled Worker Class in, I think, 2005. She claimed NOC work experience in 2002. The work experience was fraudulent. By the time she got to her interview, they told her they had 2 concerns: the validity of her work experience (she had submitted employment contract, tax info etc - all fraudulent) as well as (if it is in fact real) that there was enough work experience for it to be considered an equivalent of 1 year full time work under the Canadian standards. Basically, she was told to go find out how many hours she worked while they verify her documentation. She withdrew her application after the interview stating there were in fact not enough hours to make it a full-time 1 year and due to fear of a "rejection" being on her file she would reapply at a later time when she has gained enough work experience.

When I asked her why she ever applied without real work experience, apart from whatever reasons she had to need to apply, she said she somehow thought that the CIC would never verify the documents. They would either believe her or they wouldn?t. And if they didn?t, they would reject her application. Right now it seems beyond foolish.. but what was done was done.

Now, after, I believe, 2 years or so she wanted to reapply thinking that she should be fine as long as she downplays the fraudulent work experience as part-time (since she would have to put it on her 10-year history to be consistent). In the mean time she?s accumulated 2 years of real applicable work experience in Canada. In fact she could apply under the Canada Experience Class. But then, she really doesn?t want to have to "be consistent" because it?s continuing a lie. So she thought by applying in 2012 her fraudulent work experience will be outside of the 10-year mark and will not need to be claimed. Therefore if she gets her immigration she will have gotten it without any fraud. (I also heard somewhere that every application is considered on its own merits. What does that really mean?)

I know some of you will say she should just confess, but like I said, she?s a good friend and who knows what the punishment will be. I mean, it?s one thing if it?s a two-year inadmissibility, but worse?.. That would be devastating. Maybe for some that wouldn?t even matter. I get a sense here from some people that they are just ready to immigrate to any country if Canada doesn?t work out. It?s like shooting in the dark. I know that in this case it is not so. She has been in Canada for 7 years and this is her home in every sense, and that error of judgment she made 3 years ago may have ruined her chances to ever materialize her dream.

Anyway, I?ll leave it for you to judge. I?m here to seek some guidance because I want to help a friend. So if there is anything I don?t know or couldn?t find through my research, I?d appreciate if you pointed me in that direction.

dude u don´t have to stress out...ur friend made a mistake and did a bad thing by lying...but who didn´t? no one wants to lie or make things up, but sometimes there is no choice...
for sure she should not lie in her application for ethical reasons and also for the simple reason that CIC agents are not a bunch of idiots...they can tell if something doesn´t look good. anyways ur friend has 2 choices, either she keeps her lie and downplays it as u said and get her process going...or just wait till 2012 and do it over again. so i guess the decision goes back to her.
i personally did not lie in my application, but i can´t really blame her nor can anyone else cos the immigration matter is complicated, and it´s easy to judge someone when u didn´t have to experience the same thing he or she went through...
anyways tell her to do things the right way and get as much experience as she can, that will truly help her. and no more fake stuff...it won´t get her anywhere

Having misrepresented herself she runs the risk of being found out by CIC and this could have bigger implications to her getting her Residency.

Personally I wouldn´t recommend perpetuating the incorrect information. Should she be granted residency on the basis of a fraudulent application, if they were to ever to investigate her application and find that she had misrepresented herself, she would then be at risk of having the decision reversed.

Has she sought the assistance of an Immigration Lawyer? They would likely be the best versed in advising how to proceed. Many often give 30 minute initial consultations so she could take advantage of that asking them what they think of her situation.

I think she is suffering from guilt complex. She needs to re-apply and render that part of her experience insignificant but keep the component ´facts´ believable and consistent. Next stop bullshitting about the lie... She is causing more damage to herself than anyone else. Put the major and only emphasis on the Canadian experience which is now the principal component of her work experience. Just send in the application and shut the hell up... it is not like she killed a bunch of folks and trying to cover up now!

Hey... SureShot, I appreciate your input but why not be a little more sensitive? I´ve read a lot about what the consequences of immigration fraud could be and it´s not something I want my friend to go through. I mean we´re talking some people mistyping something or omitting part of their education and they get in trouble and are not able to re-enter Canada for years. This is a little more significant. She tried to immigrate as a Skilled Worker with her entire (most important part) of the work experience completely made up.
I mean I hope there is a way out of this, but the kind of advice that tells her to re-apply and shut the hell up is not exactly helpful.
I wish this were as easy as that. I mean, I completely agree with you that no one died, what´s the big deal? After all she is now trying to do this completely honestly. And how many people get into the country not only just through some schemes, but also while hating every minute of it (because they are "forced to move away from wherever they came from). I don´t think people like that deserve to be here. My friend, who yes made a mistake, is wholeheartedly trying to become a Canadian and is embracing the whole experience and all the benefits and responsibilities that come with it.
I mean I hate to bite the hand that feeds me, but if there are some facts that you know or some portions of immigration law or something other than "shut the hell up" please share that with me, I beg you. Otherwise, what am I supposed to tell her ? this guy said to just re-apply? Her whole livelihood is at stake here?
