Subject: need your help -many questions Re: marriage
  hello, I am a canadian citizen and i am getting married next week to an Italian citizen here in canada. In August we plan to go back to his home in Italy and do a traditioanl - religious ceremon. i have questions regarding this. Will he be able to leave the country (Canada) in August, Will he be able to return in Septemeber? He is here with No Visa (6 month max). What should i do ? Where do I start?

When are you planning on submitting your Spousal PR applicaiton? Will it be inland or outland? If it is inland, once you apply your spouse will not be able to leave the country ~ or if they do and are not admitted back into Canada, they forfeit their application.

I would recommend getting married, send an outland application. Go back to Italy in August and return to Canada with copies of your marriage certificate, your application fee, and copies of any documentation you receive from CIC to show that the application is in progress. The IO is then likely to issue a Visitor Record for your spouse which will be good for 6 months. Keep in mind however that it is at the discretion of the IO if they allow your partner back into the country.

My husband just did an outland application through Rome and we were about 5 months from the time it was submitted to Mississauga until he received his passport back from Rome.

Carrie thanks for your help. my fiancee arrived here in January and wil be leaving prior to the 6 months he is allowed. I will meet up with him in August , we will marry in the church and come back in September. My main concern is getting him back in Canada. can you explain to me what an OUTLAND app is ? Also, am I missing anything? Will there be any surprises? Thanks so much for your help

When you fill out your application, you can either file an outland application where the paperwork is shipped to a post out of country, or you can file inland, the papers are processed inside of Canada.

There are 2 sets of documents. Given your situation, you are going to want to select the outland application.

Bringing him back to Canada shouldn´t be too difficult if you have already submitted your application. Given your timing, and if you file an outland application, you will have a letter from Rome saying that they have started processing your husband´s application. This should be sufficient proof along with your marriage certificate to show that you are in the process of bringing him legally.

From start to end, it was 5 months for our application to be processed and approved. Hopefully it is as quick for you and you can get the PR visa before you come back to Canada.

let me understand this more clear.

we are getting married saturday(6 days from now). Should immediately file for the PR ? Should i do this before or after Saturday?
Also, what is the benefit of choosing Outand versus Inland? keep in mind my fiancee is here in canada now and we will be going to italy in August and returning in Septemeber 09.

He will be going before i do , as his 6 months expire in June?
he is here, as though he is on vacation, no visa of any kind. Does this make any difference? i appreciate your help on this, i really do , thanks

file for the PR the minute you can get your marriage certificate
Outland applications take far less time and if there is a problem you have the right to appeal. even if your partner is in Canada, file an outland application.

make sure you do a complete job of substantiating your relationship. Don´t be in a hurry to mail things off - take your time, read the question very carefully, read them again. put everything away for a few days... look at them again. It is your job to prove your relationship is legitimate and not just for PR status. CIC is looking for reasons to say no, so prepare your documents accordingly.

Immigration has every right to deny your partner entry into Canada so don´t make it look like he is moving.

thanks again for your help guys. what can i do, other than what you have told me to do to assure that we can go to Italy and return together without any problems. Should i explain wehat we are doing? in other words, be honest. Any other thoughts regarding this. thanks

Just move ahead with your plan. Take the time as Sharon says to fill out the application form. Mail it off to Mississauga and then you wait.

It will take 30 to 45 days for you to be approved to sponsor your spouse. Then the application will be sent to Rome for processing. You husband can remain in Canada as he is here on a vald visitor visa. He will either need to exit Canada on the expiry of his visa or request an extension, but he must remain in status.

Once you get to Rome in August, you should be close to finishing the process. You will have received paperwork from CIC indicating that you have been approved to sponsor and that the application for your husband is in process. When he comes back to Canada with you in September, bring these letters, your wedding certificate and have a return ticket for him. You need to show the IO that he will leave the country if the application is not successful.

Honestly, if you take time to complete the application well, by the time you are ready to come back to Canada, you will be close to getting the passport request if your timeline is anything close to ours.

Don´t stress, just put your head down and start working on it. Remember quality over quantity.

Hi,

I think that what they wrote above could be a little confusing for you. So I am going to try and explain this a little clearer.

Apply for the PR after you get married.
They kept writing "Outland"- You can apply from within Canada but he has to stay in Canada during the application process and you CANNOT appeal- if they deny the visa, that´s it
or you can apply from outside of Canada- in Italy. If it gets rejected, you can appeal the decision.

I am a Canadian and common law with my Italian boyfriend- but I am living in Italy.
We applied from Italy. It took about 2 months.
Do the documentation very carefully.
I would recommend that you get an immigration lawyer if you have the money!

Is ther anyone in South Africa that can help me get an Italian Passport. I have been married to my Italian husband for 2 years afer being together for 7 years. We wish to retire in Italy in about 15 years time and I know this is a lengthy procedure but need some guidance . Any help appreciated.
