Subject: Spouse 's removal from Application after medical.
  Hi,

I have applied for immigration under skilled worker category last year.Received AOR June 5,2008.My marriage got fixed after that so I went back home Sep 2008.Got married in Nov 2008 and updated spouse in application along with fees and marriage certficate.

During this time next day of my wedding I received an letter for requirement of interview with visa officer and interview date was in Jan 2009.So I came back in Jan 2009, attended interview , visa officer asked me to provide evidence of support to prove that marriage is bonafide.

Officer also said that ur application is approved.

In feb 2009 I received the medical instruction and letter to provide supportive documents( Photographs, joint bank account, insurrance policy etc...).

So I sent out about 100 photographs( wedding ceremonies, honeymoon and some family pictures),joint bank account, wedding invitation cards, travel arrangement, marriage certificate. Medical But after 2 weeks , I received a letter from different visa officer that the documents I have provided didn;t satisfy that marriage is bonafide, so officer has removed my husband from the application and currently proceeding with my application only.

Please advise what should I do now.My case is being processed in Detroit.

Thanks a lot.

You should seek judicial review at the federal court of Canada. But there are time limitations.you should contact a Canadian immigration lawyer ASAP.

Thanks Amir,

So far now, as advise of my Immigration consultant, I have written a letter to Program Manager in Buffalo, along with provided copy of emails, online conversation, profiles on face book, call history , phone bills, Marriage certificate, around 250 photographs, video c d´s , insurance policy, reference letter from some special guests in the wedding from Canada as well as India. Also I have submitted the copy of proofs which I sent earlier.
Should I wait for second reply.Or Should I hire a Lawyer.

Please reply ,

Thanks a lot.

According to the federal court act there is 30 days time limit for the application for judicial review. The court may extend that.I am also a licensed consultant, and I tell you forget about your consultant or any consultant at this point. You need to get in touch with an experienced immigration lawyer, and not just anybody.

There are many qualified immigration lawyers; you have 60 days from the date you received the refusal letter to file an Application for Leave and for Judicial Review to the Federal Court of Canada. Mario Bellissimo is a certified specialist who has worked on many successful medical inadmissibility cases. His website is "obr-immigration.com. You can reach his office director at "ksa@obr-immmigration.com. Best of luck

Sumyr you are wrong (in reply to: Spouse 's removal from Application after medical.)
there is no refusal decision on the application but a decision to exclude the spouse as a family member. It is not the same.

Extremly urgent ,plz help, (in reply to: Spouse 's removal from Application after medical.)
I have submitted additional supportive documents and some reference letters as per lawyer´s advice. But I received the letter from the same visa officer that additional supportive documents had not overcome his concern,so he is proceeding with principle applicant´s file only.He has taken off the spouse from immigration application(Still he feels that marriage is not bonafide).

Also sent a request to principle applicant to submit the passport for PR Visa.

I am worried what should I do now,
should I submit my passport now without my spouse application processing or no.

My lawyer is suggesting me to submit passport and later on do spousal sponsorship.
Will it be a problem for me prove that marriage is bonafide during sponsor ship process of spouse.
