Subject: PR Status - Please help
  I stayed for about 1 year(11 months exactly) in CA after I landed. I could not get any job offer in Canada during that time but I got a contract job offer from US on H1 that I just completed. My Canadian PR will expire in March 2010. Last year I got married and my wife was staying with me in US. Now she just left US and went back to her home country. I did not file her sponsorhip application since I am not in Canada. I have not paid any taxes in Canada.

I did not complete the 2 year stay in Canada in the last 4 years. I didn´t know that I have to stay atleast 2 years out of the last 4 years. I admit it´s a mistake on my part but how can I rectify this? I am planning to go to canada next month and stay there for ever.


My questions are:

1) Will there be any questions at the airport on my stay in US when I go to Canada?

2) Can I sponsor my wife for Canadian PR after I go to Canada next month?

Will there be any issues? I need your expert advise. I am very much worried. Please help with your suggestions.

Unfortunately I think you are in a bad spot. Given that it is now April, you don´t have sufficient time to make your 2yr requirements even with the initial 11mo you remained in Canada. Failure to fulfill the residency requirements means that you are no longer a PR and can be denied into the country.

1) Yes, you will be asked when you left Canada. This is actually a field you need to complete in the customs/immigration form you fill out when you land.

2) ONLY if you are able to make it back into the country, which I believe are going to be between slim and none.

Had you decided to do this in January, you would have been able to fulfill your 2 yr requirement, however it looks like you have left this too late.

Thanks Carrie.

I did not know this until last month. Had I known earlier, I would have gone in January itself.

But I don´t understand how they keep track of when I left the country. When I left Canada, there was no stamp on my passport. Only I know that I was in Canada for 11 months. I don´t want to lie but in this case if I say I was there for 13 months will it be a problem.
